A SUSPECTED drink-driver has been disqualified for four years after he crashed two months on from a completing a previous ban.

Myrvays Bondaryev’s car collided with a stationary vehicle in Derby Road, Southampton on January 27.

Southampton Magistrates’ Court heard that the 22-year-old construction worker had only just finished an 18-month driving ban for driving while under the influence of alcohol.

Following the Derby Road crash Bondaryev was reported to have walked away from his car but was spotted by police when they arrived on the scene.

Prosecutor Graham Heath said: “Officers located him and tried to speak to him.

“They found his speech was slurred and he smelt of alcohol.

“When an initial roadside breath test was completed, it indicated a reading of 148mg of alcohol in 100ml of breath.”

The court heard that Bondaryev was taken back to Southampton Central Police Station but he refused to carry out a breath test, citing problems with his throat.

He also declined to give a blood sample

It followed his original conviction in 2016 for drink driving, which led to his disqualification and £550 in court costs and fines.

Mitigating, Jamie Gammon told the court Bondaryev “did not understand the seriousness” of not giving a specimen for analysis.

He said: “He didn’t realise how important this is. He did tell the officers that he had asthma.

“He says he doesn’t fully understand the situation and had no medical reason to not take other tests.”

The court heard that Bondaryev had lived in the UK for more than seven years and prior to his first driving offence had been of good character.

Magistrates added Bondaryev would receive a serious punishment due to the “stupid decisions he continued to make”.

Bondaryev, of Court Road, Southampton, was sentenced to eight weeks in prison, suspended for 12 months, which includes a requirement to carry out 120 hours of unpaid work. He was ordered to pay £115 victim surcharge, £85 costs and was disqualified from driving for 48 months.
