A PARTIALLY sighted Hampshire taxi driver has lost his appeal to stay on the road.

Council chiefs told Martin Guy it would not be renewing his private hire driver's licence because he'd lost the sight in his right eye.

The 57-year-old's bid to overturn the ruling was backed by magistrates in January, prompting the council to appeal to Winchester Crown Court.

The court heard that Alresford-based Mr Guy, who has been a taxi driver since 1970, had undergone five operations to correct sight problems brought on by diabetes.

But despite totally losing vision in his right eye in late 2002, the city council did not learn about his condition until 2007.

Licensing chiefs argued that Winchester City Council refused to renew the licence because he did not meet medical standards laid out by the DVLA. But Mr Guy, of Kiln Lane, Old Alresford, claimed he did not hold a Group 2 licence and should not have to meet the DVLA's criteria.

He added: "I have never had any complaints about my driving - I've customers who know I'm blind in one eye and they still use me.

"I can't suddenly stop driving, I have to carry on working to live. I've got a daughter going through college, who lives with me."

But Judge Thomas Longbotham ruled in favour of the council.

He said: "The burden of proving an exception to go against the council's policy lies on the individual and this court has heard no medical evidence of this."

Why? He's perfectly capable of driving. It just sounds bad, "taxi driver blind in one eye", but hey, that's rhetoric for you. Contrary to popular belief, people with sight in only one eye don't wander around bumping into things and driving in front of oncoming trains all the time

Considering some of the murderously unskilled morons driving taxis these days - like the one I had the other day who obviously had only learnt to drive on his way from the asylum centre, was so nervous he braked about 100yds behind every hazard and had to ask me to turn his car around in a tight spot - I think I'd prefer old one-eyed Jack here

I was driven around several times by a work colleague that had sight in one eye, what a nightmare. Perhaps the taxi drivers eyesight is different in some way BUT it scared the hell out of me.

Would it be a different story if a taxi driver with sight in one eye hurt or injured somebody through his driving, would you moan at the council for giving him a licence??

Why don't you people, who write on here to complain about bad taxi drivers, write to the council instead. It is they who issue the licenses in the first place, so they should be held responsible for the drivers who can't talk English; don't know where they're going;hold a driving license they bought from a man in a mosque; have no checkable work record etc.Every taxi has a number, just make a note of it next time you are over charged or receive bad service, then write a letter of complaint to the licensing authority and make sure they follow it up.

Well done Winchester City Council for appealing to crown court. Diabetes can effect both eyes, blind in one - need we say more!!

oh magoo you did it again

what a crazy idea to have a partially sighted taxi driver driving people around , sounds like mr magoo really does exist.
vehicles already have BLIND SPOTS & this taxi driver has a total blind spot all to his right side 180 degrees.
i am sure that if this man was ever involved in an accident that his insurance would be invalid for himself & his passengers & anyone else involved.

i think the judge & the council made a very sensible decision in this insightfull case.

surely this avoided an accident just waiting to happen.

When you see some of the people that have been given a Motability adapted car when they can barely walk, I'd rather take my chances with a one eyed taxi driver.

but none of those people carry around the public, and their cars have been adpated and made safe for them to drive how can you adapt a car to give the sight back in the right eye?
