Football League want Southampton to forego right of appeal


PINNACLE remain very confident they can complete their delayed takeover of Saints following the Football League’s emergency board meeting today.

The Matt Le Tissier-backed group failed to do a deal before their 21-day period of exclusivity expired on Friday evening.

In what was a huge anti-climax, the takeover wasn’t completed due to the Football League asking Pinnacle to waive their rights to appeal against the club’s 10-point deduction which comes in at the start of next season.

As Pinnacle refused to do that, the League have yet to issue them the licence needed to play in 2009/10 – a licence that was withdrawn after Southampton Leisure Holdings PLC, the club’s parent company, had entered administration.

But following talks over the weekend, the Echo understands that Pinnacle believe the problem will be ironed out after the League’s board meeting today.

Pinnacle’s Tony Lynam said last night: “We remain totally confident the takeover will go through.”

The last-minute delay with regards to Pinnacle’s appeal against the deduction led many fans to question why that matter had not been sorted out earlier in the period of exclusivity.

Lynam said the League have always been aware of Pinnacle’s plan to appeal but it was not until the middle of last week that the stumbling block which was made public on Friday came to Pinnacle’s attention The 10-point deduction imposed by the League last April following Southampton Leisure Holdings PLC’s descent into administration is not the stumbling block to Pinnacle completing their drawn-out takeover.

Instead, it’s the club’s right to appeal the points deduction.

Lynam said: “The issue of the points deduction is for another day. We just want the right to appeal against it.

“We don’t want to make an enemy of the Football League, we realise we need to work with them.”

Lynam added: “This is not a new issue, rather something which we have made clear from day 1 – and something which the Administrators of Southampton Leisure Holdings PLC (Mark Fry) has been party to since we engaged in our discussions.

“We remain totally committed to completing this deal as it is clearly in the best long term interests of the club and signifies a new start with the right people in control of Southampton Football Club, signifying a fresh start and an opportunity for a brighter future.

“Significant to our ability to complete our takeover, we are simply asking for clarity, nothing more, nothing less.

“Our understanding is that such confirmation will be forthcoming shortly.

“We will continue to work hard with the Administrators of Southampton Leisure Holdings PLC to finalise these matters.”

As revealed in Saturday’s Echo, a consortium featuring Marc Jackson and Stuart Green are waiting in the wings if Pinnacle’s deal does not go through.

A Swiss-based group also remain interested.

This is a done deal... All Pinnacle are asking for is a fair hearing. It is completely reasonable for them to want to appeal and they are not going to let the League Bully them.

This is a good sign and shows how serious they are.

Tim, if the situation had been reversed and Saints were relegated because some other club won this argument on a technicality we'd be outraged. The Football club and the PLC are in this case more or less the same thing so this attempt to separat them is facile legal hair splitting. Next year every club in the league will simply register their financial department as a separate limited company and we are back to square one. This isn't Unilever, this is SFC PLC pretending it's still an old folks home. How Pinnacle went into this thinking the League would change their minds is beyond me. Are they that naiive? Just because we want something to happen doesn't make it right and in this case sorry to say it but SAints have to take their mdedicine and get on with it, as other clubs have had to do.

This must be the most tedious takeover in history. Lets hope that it gets resolved today oneway or another. I just cant believe that this problem hasnt been sorted inside 3 weeks. Makes me wonder how good these so called business men are that are taking over our club.

I agree with Bitterne Park Tim. All we need is a fair hearing and for Mr Fry to fight our corner. It was the Soton Leisure Holdings that went into adminstration and Mr fry says the club did not.

To be honest, as long as we get a hearing, salvation for the club is the most important thing. If it means 10pts then so be it. My only wish is that Messrs Lowe and Wilde are given life bans from St Marys.

As for the 10 point deduction I understand why the league are sticking to there guns. I just wonder how Stockport can go into adminstration after the deadline and yet escape the 10 point penalty. Can anyone help on this matter ?

Like Bitterne Park Tim says it's entirely reasonable that the club gets a fair hearing for an appeal. Foreswearing the right to one is succumbing to blackmail, and blackmail was illegal the last time I looked it up.

I'm encouraged that there appear to be steady nerves behind the bid, as well as what seems to be a genuine concern for the club.

What concerns me slightly more is that what was presented as a "wealthy individual" now is referred to as a "group" or even "consortium". But I suppose that everything will be revealed in due course.

Very admirable to stand up to the League's unfair rules but the league know **** well that if they back down in our case this will open up Pandora's box and the likes of Leeds, Luton, Bournemouth, Rotherham etc could bombard them with law suits. Can they afford that?

I think most Saints fans (and most football fans if they thought about it) would agree that the League has crossed a line here. Yes the 10 point penalty is a contentious issue and if I supported another team I would probably agree with it (even if it technically wrong) BUT blackmailing us into not appealing, actually breaking their own rules by effectively withdrawing the right of appeal????

Kick David Mellor out of football was a brilliant campaign - kick Mawhinnie out would be even better...

mate, i think you are missing the point. Its the football league denying the right to appeal that is the issue, will we be successfull?? maybe not but it a basic right that pinnacle should be able to appeal. The more i look into the legalities of this, the more chance I feel pinnacle have. Not just to help us, but to help the other clubs that have been unfairly sanctioed.

well put Andy, whilst we may feel aggrieved that other clubs such as Derby have got away with it, the FL have to start putting their foot down to make sure clubs take some responsibility for their finances.

It was an Echo headline on here that was quietly removed an hour or two later that started this false trail. Stockport WERE deducted 10 points - it simply did not relegate them so they stayed up (just). If we had finished last season with 17 more points we would have taken the 10 point penalty and stayed up by one point in a similar manner to Stockport.

The 'after the deadline' thing is only an issue if you are relegated anyway before the deduction (as we were) - then it is held over. If we had come fourth from bottom last season we would have been relegated by the penalty points and started on 0 next season. If say Swansea, Ipswich or Cardiff had have gone into admin after the deadline they would simply have dropped a few places in the table - it would not be held over. So you can actually go into admin with relative impunity if you are not in the play-offs and you have enough points (ie 10 or 11 above the drop).

I cant understand some of you? The league knew how we were operating? They just chose to ignor it. How about change your rules to reflect clubs that abuse loop holes.

Classic case of locking the gate after the horse has... The league have sloppy rules, not sure how that is our problem.

The right to appeal is the right to appeal. The league need to keep their own house in order.

Then the FL should of closed the lop hole after derby county , not down to southampton that the FL is full of morons

Andy, I actually do agree... But the fact remains Saints did not go into administration, it was the holding company... We worked a loophole. if the League were too slow to close that loop hole that is thier problem not ours! I think the league could have done loads to stop clubs getting into huge debt etc... and i really hope they do, but they cannot bully us and say sorry you can only own Saints if you agree with us! That is ridiculous.

We do actually deserve the 10 points.. but if there is a way of avoiding it then go for it!

Andy, are you seriously saying that SLH were formed with the intention of avoiding a 10 point deduction for the football club? SLH were formed in 1986 and was used as a "vehicle" to purchase the football club and many other activities such as the insurance and radio arms. The Derby County (and West Ham)scenarios are I think irrelevant because I believe they come under the Premier league rules which are different. The league are attempting to insert an unfair contract term into its agreement to allow us back into the league. If SFC folds (which it won't), I don't think Norwich Union's lawyers will be too happy.

Why wouldn't the FL ignore how the club was operated? I don't think it was within their remit to advise clubs on how they structured their business, just in case the club went into administration.

Not an argument I'm afraid. On the other hand, I fully agree with your other argument; it's our RIGHT to appeal, so why shouldn't we? To withhold our licence subject to waiving that right is tantamount to blackmail, as has been suggested in previous posts.

I hope the FL will see sense and grant the licence and that Pinnacle do appeal. What are the alternatives? The FL withhold our licence (can we appeal in time for the start of the season?) or Pinnacle withdraw their bid? Will any other bidder be prepared to bid for the club and waive their right to appeal?

I think the league have done what they have for many years previously. They judge on a case by case basis. The league are still an 'old boys club' and I do think that they know there is a loophole that the Saints know full well is questionable. They definitely would not want to lose face and like a few have said on here, if they were confident enough they wouldn't be concerned about the fact that the Pinnacle Group wish to challenge the ruling. I suspect that none of us know the rules so I am more than happy for the legal parties to iron that out. If there is a loop-hole or any other reason that means we can get out of the 10 point dedeuction then I don't see any reason why we shouldn't pursue it! We would only be doing what any other club would do if they were within their rights.

Roll on the take-over, Matty getting on the board and The Saints going from strength to strength! Positive thinking Saints fans!

There have been comments about his name sounding like Ali Dia but trust me its not a wind up.

He has properties and a wealth of over 700million.
He has suggested that he may well give the new manager £50m to get who he can for League 1.

It was an Echo headline on here that was quietly removed an hour or two later that started this false trail. Stockport WERE deducted 10 points - it simply did not relegate them so they stayed up (just). If we had finished last season with 17 more points we would have taken the 10 point penalty and stayed up by one point in a similar manner to Stockport. The 'after the deadline' thing is only an issue if you are relegated anyway before the deduction (as we were) - then it is held over. If we had come fourth from bottom last season we would have been relegated by the penalty points and started on 0 next season. If say Swansea, Ipswich or Cardiff had have gone into admin after the deadline they would simply have dropped a few places in the table - it would not be held over. So you can actually go into admin with relative impunity if you are not in the play-offs and you have enough points (ie 10 or 11 above the drop).

Well, you suggested that the FL ignored how we were operating. To do other than ignore it, they would have to advised us to change it, and that - I doubt - is what they are there to do.

No club should have 10 point deductions carried over to a following season, when they're owned by a completely different business/board. Ok, we're bound to be a little biased here because we find ourselves in this situation, but as far as I'm concerned deductions should take place immedidately, regardless of where the club is in the league table. Otherwise, it's a different rule for those who finish in the relegation places than for those at the top, and that just can't be right, surely?

no the opposite is true. why should club "A" have the right to wait to see if it gets relegated and then go into administration to avoid paying creditors?

as why should club "B" say well now we are relegated were f**ked so lets go into administration and save some cash.


its to make sure either way owners that appear to be attempting to absolve themselves of their financial commitment to the club cant walk away/sell off without being held to account.

that said its still aa crap way of sorting it out, but thats what happens in business, which aint emotional or sentimental.

I think McWhinney and FL are being very bitter and childish. If they were confident they made the right decision on how they implemented the -10 points why are they worried. SFC deserved to lose 10 points last season like Stockport who went into admin about the same time but like Stockport it should have been last season. same rule for everyone. Refusing us a place in League 1 will lose a lot of money for many small clubs in our region who would be looking at full gates playing Saints and selling tickets to SMS.

Afternoon all.
After spending the morning checking every possible source for information - nothing more interesting to report than the FL meeting is today!
Honestly what a wasted day this is going to be - can't concentrate on anything at the moment. Even the thought of kinkyboots70 (is that her age?) posting something about the hire of a big Merc from the airport to SMS doesn't excite me any more!
All this speculation on the 10-points issue is crippling me! There is no easy answer - sit tight and await the statement from the FL, then Pinnacle and finally Mark Fry...not necessarily in that order - but you know what I mean!
Oh well back to hunting for that MX5 I promised her in doors (my toy really!) - until later friends and fellows saints fans!

I do agree with fellow posters who have criticised the whole business of points penalties because it penalises the fans - the one innocent group in all the mess. It's difficult to know what to say to Luton fans who's lifelong passion was destroyed by a 30 point penalty that killed the club they loved. I don't have an answer except that ever since the Premiership and Sky got into bed together the rest of football has been slowly and painfully dying, and if I could wish for just one thing it would be to isolate the Premiership for ever by stopping promotion and relegation and reinvigorate the whole pyramid with the Championship (not the Premiership) as the real home of English football. I'd give the Premiership 5 years before it collapsed under the weight of its disgusting excess.

Why are people forgetting the point made a couple of weeks back that stated, from Pinnacle, their backer has never had anything to do with football or any football club. I am in total agreement with you. Ageing rock stars and football legends are just dreams. Mr A. Dias DOES have the credentials. I've managed to check him out. As for Dowie, maybe not so bad. He has got the experience even though he hasn't been spectacular. Mike Channon is a succesful horse trainer, but he's never won a classic. Let's get our team up and running first and then decide for the future.

I would be just annoyed if I where a Swansea et al. How likely where saints to take points of the likes of Burnley if we where already relegated?

The League where happy for a family club to be taken over in a reverse takeover and floated on the stock exchange. They sanctioned the creation of the PLC monster and now they want to destroy the club in some misguided attempt to halt the excesses of football.

The sole reason why saints are in admin is the debt of the stadium. A move sanctioned, neigh encouraged by the league.

This season we have spent virtually nothing on wages and attendance have dropped accordingly the net result the PLC has gone into administartion.

sorry but your firing off from the wrong base.

SFC holdings went into administration, because they couldnt meet their commitments to creditors which included all the players and all the staff. they havent paid anyone since april. the administrator has paid the wages with transfer money and exclusivty agreement wit pinnacle, plus personal donations from Mr Crouch.

the wage bill is still approx £500k a month. and yes ironically if they were in a sold out 16000 stadium with the correct stewardship they would be ok.

I had intended to steer clear of the guessing game on the mystery bidder but I thought I might chip in with a few thoughts/ questions. Not being funny or trying to wind up but …
Does anyone else think that it might not be a massively wealthy person or at least they don’t have the intention to bankroll the club? I am not accusing Mr. Lynam of deceit in the correspondence he has graciously addressed to the fans. However, why buy now? I know that the club is without an owner so now is an ideal time for one to appear. But owners that have millions to spend don’t always just pop up at these times. On the one hand the club might be cheaper now. For instance the shareholders don’t have to be paid off. However, the debts have to be cleared at a level acceptable to the creditors. Could ownership not have been secured for a lot less and then the mortgage be renegotiated afterwards (I believe it that was happening anyway)? Would a serious buyer with intentions to invest/ waste money on Southampton and has a fan-like attachment to the club wait until administration hits the club to come out of the blue? Is purchasing a club in administration more troublesome than when not or easier? If they were previously interested, would they have not known of the 10pts rule?
Can Lowe’s complicated SLH structure or his intransigence/ share price be the only reason for a purchase now? Where were they 13 months ago or even 6 months ago? Might it instead be a case of a hobbled together group brought together to rescue the club, perhaps due to MLT’s encouragement? Will an owner like this be so generous and perhaps we ought to not raise our hopes higher we have a club in the League next year?

On the other hand - just contradict myself - now is just as likely as anyother time for someone to suddenly think they will buy a club and spend loads on it!
