HMRC drop winding-up petition against Portsmouth FC

More stories about: Pompey

PORTSMOUTH will no longer face a winding up order after the HMRC dropped their challenge to the club's administration.

Her Majesty's Revenue and Customs today dropped its legal challenge against the validity of Pompey being put into administration by owner Balram Chainrai, it has been reported.

Click below to see a video of today's headlines in sixty seconds

They were due in court on Monday, for a hearing which could have seen the club wiped from existence.

A spokesman for the club said: "The Revenue has accepted the administration is valid."

Portsmouth now face a nine-point deduction from the Barclays Premier League for entering into administration.

Even before the nine-point deduction, Portsmouth are firmly rooted to the bottom of the Premier League table and look certainties for relegation to the Football League Championship.

The nine-point deduction will leave them 14 points from safety, with just 10 games left to play.

HMRC's decision to drop their case comes the day after the administrator slashed 85 Fratton Park jobs.

Some members of manager Avram Grant's backroom staff were included in the cull, although none of them were high-profile.

But Pompey administrator Andrew Andronikou has promised fans that no players will be moved on ahead of the FA Cup semi-final.

Players cannot be made redundant due to protection afforded to them by the Professional Footballers' Association.

But the cancellation of loan agreements to save on wages is a consideration, with Pompey having six temporary signings on their books.

So what is the deal with the points deduction then? I thought i would be the same as what happened to us... if they end the season OUTSIDE of the drop zone the points will be taken at the end of this season but if they end the season INSIDE the drop zone the points will be taken at the begining of next season. I only ask because i read somewhere that this wouldn't be the case????

Correct, it won't be the case, as the Premier League rules are different to the Football League ones.

Poopey have been extremely fortunate, the PL have different guidelines to the FL in applying any penalty, but they will certainly have further point’s deductions if they enter the CCC in administration…...
. They do seem to have been given preferential treatment in respect of any consequence, especially when trading while insolvent, and probably because the PL are very embarrassed about the whole laundering operation going on at krap nottarf…..only two of their players are discussing a wage reduction, how very noble of them…….surely more penalties will follow on from the legal proceedings against PS, twitchy etc, all of who had positions of authority at the club while creaming the dollars from player transfers, and the club…in short ripping their own fans….skint dessert dwellers etc, you couldn’t make it up…..COYRs

They went into voluntary administration before a cut off date, something like March 15th, if they had done so after that date the points would have been deducted after relegation, if you remember, Saints went into adminitstration very late in the season, that's why the points were deducted after relegation. The Football League are already looking into docking Portsmouth 20 points at the start of next season in The Championship, so Div 1 football is likely for them in just over 16 months, if they survive that long. Premiership clubs are treated with kid gloves, look at Chester City who were wound up yesterday, I believe that they owe the tax man the relatively small sum of £200,000, nothing like the several million that Pompey owe.

One rule for one and one for another! I am waiting to see what the football league does for next season. I am convinced it is all hush hush at the moment just to get to the end of the season. Then I think the preverbial book will be thrown in the direction of the clueless blues down the Road. I mean the people that run the club by the way. All football fans deserve their club as without them it is nothing.

Right so Pompey live on.... excellent and with any bit of luck (not that I dont want to see them having success or anything like that) but it should take them a couple of years to re-group hopefully so maybe just maybe we might get a couple of league fixtures when we eventually get up to the CCC.... would be great to get a few wins over them and gloat!!!

Saints got the points deduction because we went into adminstration after March 26th. As P*mpey have gone into admin prior this date they get the points deduction *this* season.

Look for an article called "Southampton FC may not get points deduction from Football League" on this site.

the same may well be applied here .all premier chairman will meet round a table before a dicision is made .the other chairman may ask for this rule .for the integrity of the league .set portsmouth a task .otherwise if you apply them now they may not try .witch would effect .top of league the top 4th spot and the other teams near the bottom.dont be suprised if this rule is applied

All of this shows that there has been some hard negotiation behind the scenes and I would put my wife's housekeeping allowance on it that the hand of the PL is much in evidence.

Outside the PL it seems that there is no protection for clubs who are in difficulty.

Poopey get special treatment and the mess is all of their own making.

This is not justice but one big stitch up that should be investigated by FIFA.

Absolutely spot on,

I half expect it to happen, if you were the Glazers with that amount debt, the Manc fans on your back wouldn't you consider it?

Imagine you could walk away from Old Trafford, with no debt, after selling the assets (players) and paying possibly 30p in the pound to pay off the creditors, go back to the USA and run your American Football team, and the PL and FA will pat you on the back for running a business in the ground, deducting 9 points.

An absolute disgrace the Skates can run a business so badly and walk away scot free, 9 points to team who were going to be relegated anyway means f**k all, some punishment that is, they got sweet FA for ripping off the taxman.

Im sure they have got away with this, by letting the dust settle on the scandal and the Pl is relieved that it has died down,so they can discreetly sweep it under the carpet.
Their debt is minimal compared to others,so the PL is hoping that a "big club" doesnt go pearshaped.
But their wrong in not dealing with this rabble and setting an example.
keep it in the public domain, dont let them off the hook.
Still ,they still have peter storyteller on 75k a week while 85 get laid off, disgraceful.

I am wondering if the Premier League are doing the right thing in giving a Club in trouble a chance to put their house in order? Will they reward them if they |do put things right?

Have the Football League seen the light and are considering that their methods were wrong? If not why are they giving Southend more time to get their house in order? If they are man enough to admit that they got it wrong, why not give us our ten points back for this season and retrospectively knock them off of last season when the punishment was earned?

If pompey escape the 9 pts deduction, then Ken Bates, Simon Jordan, Peter Ridsdale, Nicola Cortese, and every other chairman of a club who have faced administration should demand they're points back, and threaten to take the league to the high court. Portsmouth are not exempt from the law, they are not exempt from punishment for gross overspending. Should finance trouble affect the field? yes 100%, because the squad out there was funded by money they couldnt sustain, wages for that squad they couldnt sustain, hense if it wasnt for gross overspending, they wouldnt have that squad, hence an unfair advantage. And still, those **** get away with it.

Advert from the Financial Times;
Meanwhile the club was advertised as being up for sale in yesterday's Financial Time for an undisclosed sum.

It read: 'Portsmouth Football Club For Sale. Hampshire, United Kingdom.

Asking price: Undisclosed. Sales revenue: Undisclosed. Net profit: Undisclosed. Fixtures value: Undisclosed. Stock value: Undisclosed.

Didn't think they would need to advertise, what with 12 buyers already lined up.

It's just plain and simple wrong, the HMRC want their heads examining as do the FA.

Pompey should be wound up and their assets sold.

THEN if their city want a club THEY should bloody fund one, not every tax-payer and many south coast businesses!!!"

This has to be the best post here.
It clearly highlights the need for the penalty, when a PL team goes into administration, to be far more than a standard -9 points.
Automatic relegation, regardless of finishing position, plus point deductions the following season would be a good starting point.

Looks to me that the HMRC have either been warned off or have been bought off, either way it makes everything rather comfortable for all concerned. Too comfortable!
In a way it all makes perfect sense, if the Skates are liquidated (I do love that term for them) then the sh!t hits the fan concerning who had beaten or lost to them, it would basically be one big f!!king mess! So, what better way to avoid this than by the HMRC backing off so very conveniently, perhaps secret handshakes all round? They will still be hit with the -9 points so PFC are all but guaranteed to be relegated.
Thats when I can see all of brown stuff hitting the Skates from all directions, including HMRC etc. If they then don't get their act together I can see the Football League being far more draconian with them, -10 or -15 anyone?
The players on loan will return to their clubs, the mercenries will depart elsewhere because none of them will want reduced wages in the championship, also there is the real risk of not being paid at all.
At the moment it stinks, and we feel that our inbred neighbours, the PL and HMRC are taking the p!ss which leaves a foul taste in the mouth. But before PFC start celebrating I think they should reflect on what will/may fall upon them very soon! :oD
