£3,000 fine for illegal tip site


A LANDOWNER has been fined more than £3,000 for failing to clear an illegal dump in a Hampshire village.

Kenneth Lovett admitted breaching an order to remove thousands of cubic metres of waste from land at Pollards Moor Road, Copythorne.

Now, the 58-year-old has been hit with a hefty fine after ignoring calls to clear the tip and failing to return it to its original state.

However the sentence, handed out at New Forest Magistrates’ Court, has done little to appease neighbours of the Lovetts, who say the fine will not improve the situation.

The verdict came just months after experts warned that the tip is likely to produce methane, an extremely combustible substance capable of seeping into surrounding properties and triggering a blast.

There is even a risk that asbestos could be buried among the rubbish.

The saga began four years ago when 12,000 cubic metres of waste was dumped on the land, in the New Forest National Park.

Magistrates heard how, despite attempts by the defendant to remove some of the material, a further 600 lorry loads may be needed to completely clear the site.

The court was told that although Mr Lovett intended to remove the tip, it would cost him a further £300,000 to finish the job – cash he does not have.

Originally he was due to appear before magistrates along with his wife Jacqueline, 57, and daughter Michelle, 33.

But before the sentencing, Mr Lovett took responsibility for the situation and the case against the rest of his family was discontinued.

He was ordered to pay a £3,000 fine and court cost of £650. An enforcement order to remove the waste and return it to its original state is still in place.

New Forest National Park Authority (NPA), which brought the prosecution against Mr Lovett, may consider further court proceedings if the order is ignored.

After the case, Ruth Farmers, one of the people living next to the land, said: “This sentence is no satisfaction to us, because the waste material is still in the field.”

Mr Lovett used the rubbish to raise the level of his land and prevent it flooding.

Earlier this year he warned that his family would have to sell their house, leaving them homeless, if they had to pay part of the bill.

Apologising to his neighbours he said allowing a waste contractor to dump the material was “the stupidest decision of my life”.

If by "experts" they actually mean their own scaremongering journalists, then, yes, I suppose you could be forgiven for thinking there is a risk. Personally, I'd rather trust the opinion of the consultants who investigated the site and said it was INERT waste.

In this day and age when thousands of public servants are losing their jobs because of financial cuts, the thought that these ignorant locals are demanding that this innocuous field be dug up at an estimated cost of over a million pounds of public money (despite being told by every interested party that there is no risk) is really starting to annoy me.

I know something of the history of this action and I cannot believe that the reporting of the actual facts has beenso poor to date. All experts so far called have not found any significant organic material to justify this witch hunt.I have lost all respect for the parks representative who continues to waste our tax payers money when they have admitted at a public meeting that there was no evidence to suggest that the law had been broken regarding landfill of organic waste. my sympathy's go out to the lovett familly

I agree with you both.

Checks and balances and local bylaws and national laws exist for a legitimate and important purpose.

Without laws governing people's personal or public behaviour we would all live in a World of Anarchy, with everyone doing whatever they please, wether it was right or wrong, an innocent activity or hurtful to others.

If a law is unfair then action needs to be taken to have it repealed.

If a law is applied unjustly or incompetently or illegally, then action needs to be taken to challenge that and have a wrong put right.

Otherwise, we should stick within the laws and if we choose to step outside of them or try and circumvent them then we should not be surprised nor moan if we get sanctioned or penalised..

This man knew that, when he decided to do what he did.

I have zero sympathy for him.

Planning permission was not required for agricultural improvement. Waste materials can be used for this and as described by DEFRA waste materials can be Demolition, Construction and excavation materials including small amounts of metals, Plastic and rubber.

Defra in one of their documents stated that they wanted to encourage land owners to use these materials to reduce the amount going to landfill and enable Defra to reach their 2012 landfill target.
This case is continuing because accusations have been made that there is contamination (2 surveys carried out so far costing in excess of £20,000 and it has been reported that it is not hazardous) also because I was encouraged and coersed into applying for retrospective planning permission which I did and then the NFNPA had control and refused the planning.All of this information and evidences were given to the Echo reporter in a interview with him several months ago. Up until now none of this has been printed.
I must also point out that the law has changed this year but you can still use these materials for agricultural improvement but you have to apply for a permit from the EA. All I was trying to do was imrove the field for my livestock and my grandchildrens pony.

Mr Lovett, to you and your family I wish you the best. Your only mistake, as far as I can see, is to chose to live in stuck up neighbourhood with neighbours who think they're special. If you ask my advice, let them take it all, join the council list for a nice new home to house you and your family, get the income that comes with it. Enjoy your retirement with next to no bills all courtesy of your neighbours. You too could end up with multiple properties, nice car and no worries in the world. The UK is such a wonderful free living society I mean just check out how many free loaders they're are. It just doesn't pay to try to do something for the better. I still am confused though how come these neighbours of yours are environmental experts with qualifications and degrees coming of their wazoo's to be able to tell us inert material produces methane... perhaps, just perhaps they solved the worlds forthcoming fuel crisis.....My Lovett you might be onto something here - GOOD LUCK
