Union legal claim postponed after Southampton City Council strike talks progress

A £12.5m legal claim by the unions has been postponed as progress was made in direct talks with Southampton council chiefs to end crippling strikes.

Talks broke up yesterday for union negotiators to take a possible deal back to a mass meeting of members tomorrow as hundreds of social care workers are due to join striking bin men and street cleaners in a one-day walkout.

The details of the possible agreement were being kept under wraps last night but pressure is mounting as legal protection from dismissal for striking workers will run out at the start of next week.

Residents associations across the city have demanded an end to the bitter industrial dispute over pay cuts – now in its 12th week.

The talks resumed yesterday after a first hearing for an employment tribunal claim was postponed at the request of the council with no new date fixed yet.

Unions’ claim that the council failed to consult on its plan to dismiss workers if they did not sign up to worse contracts.

The council said it needed more time to prepare. Unions stressed the claim has not been withdrawn.

Up to 2,400 members of the Unite and Unison unions are continuing industrial action over cuts to their pay and conditions brought in on July 11 under threat of dismissal.

More than 300 social care staff, including adult and children’s social workers, voted to join ongoing strike action tomorrow after a one-day walkout last week. It was planned to coincide with the start of an Ofsted inspection of the council’s services for children.

Around 50 members of the council’s fostering, adoption and residential childcare teams are already on strike.

The council says the pay cuts will protect 400 jobs as it seeks to find savings of more than £75m over the next four years.

Council officials say they are confident they can defend the tribunal claim but admit it could cost the council £12.5m plus costs if they lost – wiping out savings from the pay cuts.

Neither the council nor the unions would comment on the latest round of talks last night.

Earlier talks through mediation service ACAS collapsed in stalemate despite a final offer from the council to lift half the workforce – those earning less than £22,000, including most bin men – from its cuts.

New contracts brought in four weeks ago cut the salary of workers earning over £17,500 by between two and 5.5 per cent, depending on earnings. Pay rises were also frozen for two years.

The legal action is still going ahead, they postponed the pre trial hearing to allow council more time to prepare, this is likely due to the 1,000's of unfair dismissal claims coming in.

And it shows that the union ares still willing to negotiate if the Council want to start to.

I hope the council will negotiate and the dispute is bought to an end, either way the claims will still be in and more are coming, council need to think carefully about how they proceed as they have already borrowed £5m and the proceedings could cost over £12m.

If the council has so little money, then can it even afford to go to tribunal? even if the judgement is found in their favour? Rambo may be getting twitchy!

Did you read the article? It said the unions were putting forward a possible deal to it's members so that concludes if the unions are happy the council are happy then the members accept the deal there will be no more negotiations & no need for a costly court case.so the council have asked for it to be postponed as this could save both unions & council money.I hope the members accept the deal tomorrow & it's over.Pheonix we had contract workers for the first time yesterday & people were coming out saying how good they were & hoping the council will keep them.the writings on the wall it would be in the workers best interest to accept this proposal if the unions agree with it.

The workers can still reject this offer. Its the duty of the officals to explain a new offer. The workers will decide if it is acceptable. Dont hold your breaths.

I did read the article, and I happen to know the legal challenge will go ahead as i dont see the council taking back the T&Cs and they have breached the law, whether they agree a settlement over the industrial action or not, the fact remains Southampton City Council broke the law and all claims recieved will go ahead.

Interesting definition of 'lost'! perhaps a dictionary may help you.

Why stop at union reps? Why not make it everyone who earns over £100k disclose, or £50k.

I'm not sure how that will help, unless you want to increase their tax rates.

Personally, all I've suffered is a little inconvenience. The Council appear to have been ineffective and I'm not impressed. the Unions have been power grabbing and I'm even more not impressed. The workforce, mostly, appear to be a rather large flock of sheep though much less use to me that a flock of sheep would be.


Maybe the Unions and council and workers should consider this. Cuts to terms and conditions are deemed necessary to balance the budget if we are to save jobs and retain service levels - in the short term. In the long term there will be more job losses and more cuts, of that I have no doubt. HOWEVER if the Union go ahead with the legal challenge that will wipe out this years savings, so more job losses and service cuts will happen sooner.


So nobody is going to be happy., except the Unions.

Note: the legal action is each member's own decision. If they feel cheated and wronged then they will find law is on their side and why shouldnt they fight back? They didnt cause this mess but they are the ones paying for it.

And i'm sorry retain services?... What services, most vital services to the vulnerable have been scrapped and other teams are running with a skeleton crew and are being over worked... until more redundencies arrive and then services will not be able to maintain any where near the service levels it curently delivers. It will be the residents and users of SCC facilities and services who will suffer, mean while Rambo will be sitting smug at his desk, Or workers can stand up for their rights.

If they win - then yeah good value for money, if they lose then perhaps they cannot justify their inflated wages. Personally i think they are on way too much, if what other users have been posting is correct, i dont know i'm not their accountant. But are they on inflated wages in comparison with the public sector and similar jobs?

anyone over £50k is living quite comfortably is there need for more money? Nope but Greed is everywhere...

Hi..Have been a bit poorly so have lost track a little.. However, if the employees signed new Contracts, how can they immediately go on strike> Doesn't make sense to me. I believe that if they don't go back to work by the end of this week Friday 12 August, they can expect to be sacked? Good. Then perhaps this poor City can get back to some sort of normality in time for the next round of Riots - due tonight Monday or Friday - Different Subject, I know! Is there a Communities group within Southampton City and environments which we can sign up to to Save Our City??

Have been having real trouble getting through to the echo. If a proposals deemed good enough to be put to the members why carry on with court action? surely if as you lefties are saying the council loses then any deal done now would be absolutely wasted as the council would have to find £12million more in savings? also after reading letters the unions have sent out these are showing they new of the councils actions way before the 90 days required by law so why not postpone the court case save the unions money & if the workers vote for the latest agreement then the union saves face & doesn't have to lose money on court cases.

And you have the authority to say this because you've been able to track and monitor the IP addresses of all those who voted for the whole time the poll had been online.

An “upright citizen” who cast some 2,500 of 12,000 votes. You condemn the voting by union members but praise the actions of one individual in a deliberate attempt to rig the results: 200 in one day; 60 in two minutes.

LR, apart from not having my bins emptied exactly what have I lost out on? I'm not suffering here in leafy Highfield. My family in the city aren't suffering either. Come to mention it most people aren't. The affected services, such as social work, only encompass a small minority of the population. This strike will end with the unions at loggerheads with their members, as what happened 25 years ago. If I were a union member I'd be carefully considering who to vote for when the leadership is challenged. Surely the likes of Tucker must be voted out before they bring everyone else down.

I didn't rant on about the first poll I don't give a toss about the last poll the only thing I care about is the vote by workers today.I also care about Southy & his pals making this sound like (riots) the poor rising up against the evil tyrants instead of the same thugs that wreck neighbourhoods every night & then people blame it on booze.as seen on telly this is just looting with no political agenda by those looting but the people organising it & agitating it are the political nuts who need to be tracked down & stopped so who gives a toss about a poll?

I see nothing in the content of this online report that doesn't cover what Unison has publicly said on this matter yesterday.

But certainly the title and opening paragraph are misleading and implies that the legal action has been postponed because of progress in talks.

But it is nothing more than the unions fulfilling the request of the council due to the council being ill prepared ahead of the scheduled date, (which speaks for itself really).

As a result it appears to have given a false impression to readers, especially to council supporters here, Sotonians and Judge George being good examples and considering their standpoint, that's none surprising.

Even so, his fans are disappointed.

I cannot talk of the paper edition as I'm not in Soton to view a copy right now. I bet it'll be worse than this.

Don't know if it's really protecting 400 jobs over two years now either. As I've heard a twittering of birdsong that's said it be 600 jobs!

Cuts to terms and conditions are deemed necessary to balance the budget if we are to save jobs and retain service levels - in the short term. In the long term there will be more job losses and more cuts, of that I have no doubt. HOWEVER if the Union go ahead with the legal challenge that will wipe out this years savings, so more job losses and service cuts will happen sooner. So nobody is going to be happy., except the Unions.
Note: the legal action is each member's own decision. If they feel cheated and wronged then they will find law is on their side and why shouldnt they fight back? They didnt cause this mess but they are the ones paying for it.

And i'm sorry retain services?... What services, most vital services to the vulnerable have been scrapped and other teams are running with a skeleton crew and are being over worked... until more redundencies arrive and then services will not be able to maintain any where near the service levels it curently delivers. It will be the residents and users of SCC facilities and services who will suffer, mean while Rambo will be sitting smug at his desk, Or workers can stand up for their rights.
If the council had conducted the consultation in the correct manner in the first place, there would be no case to answer.

I get the impression that the "Talabin" think that a Union member is some sort of guerilla fighter ready to kill for the cause, when in fact they are normal people who subscribe to an organisation whose aim is to protect their members from injustice, not just their jobs but also from unscrupulous managers whose aim is to exploit their staff. Until it is understood that people like the binmen are just ordinary members of the human race like themselves the can never lose the blinkered approach. Managers who know the worth of their workers not just the price can get the best from their staff.

No I think you'll find that the union have shot themselves in the foot & the proposal they put to their members today could save them a lot of money in court cases. why continue when in open letters the union has stated that they were representing people about the letters & these letters to members from the union quite clearly show they new way before the 90day legal requirement.So the unions carry on with court cases & lose how will that effect their members? if by some travesty of justice they win then what's the point of putting forward anything to their members today as the council would have to save £12million so whatever deal now would end up null in void so postpone action have a vote & then see what the members say sounds more realistic to me

Breaking news is no they haven't if even one of the deals put forward are true it was an original idea put forward by the council & rejected by the unions so why have the unions accepted it now? Can't wait for your Labour party to get in & 800 more are made redundant & more pay cuts so hopefully the unions will go on strike again

I completely disagree with this Ospreysaint.

Pay for jobs is not about what a person is "worth"

It is about what that work they do is worth in the job market.

There is a key difference.

A big issue is that too many unskilled and unemployed people have false and misguided senses of entitlement. This can also seen in the London riots

Just because a job only pays a certain amount, that does not determine that person's worth, which is much broader, and takes account of many different areas of that person's life

If people dont like what a job pays, they need to get another job. Not strike and complain about it for months at a time.

The answer is to train and improve their skills and get better jobs, not to demand unrealistic salaries for unskilled labour, for example.
