ONE of the brothers alleged to have murdered Hampshire newsagent said today he had not intended to seriously hurt him.

Jon McKinley has admitted punching Choudhry Zishan in Eastleigh High Street.

The trial at Winchester Crown Court has heard he died of severe head injuries after a sustained attack of punches and kicks.

Nigel Lickley QC, defending, asked Jon: "At the time you hit him was it your intention to kill him?"

"Of course not," said Jon.

"Seriously harm him?" "No".

Jon told the jury this morning he thought Mr Zishan was a man who had pestered his sister Ellie McKay earlier that evening in the Litten Tree pub in Eastleigh.

"Obviously it wasn't. It was a case of mistaken identity."

Mr Lickley asked Jon about a conversation he had in Fleming Park with a young couple who were with their baby at about 9am, about four hours the killing.

Jon talked about babies, Mother's Day and breast feeding.

Jon said: "I ain't got a kid, so I don't know. I have a little niece around that age. I haven't got a daughter. It was fantasy, I was drunk."

He was asked about details of events after the killing. To most questions, he answered: "I don't remember."

Jon claimed that his injured right hand and foot, which the prosecution says stems from the killing when he punched and kicked Mr Zishan was caused when he was arrested by police later that morning in Monks Way, outside the flat of Emma Humby, Sam's girlfriend.

Asked why he answered 'no comment' to all questions in the police interviews, he said: "I normally go 'no comment' when arrested. At that time I had severe memory gaps of what happened. I didn't want to incriminate myself by saying stuff in interview that could later turn out to be a lie. I didn't want to shoot myself in the foot."

Jon McKinley, 23, of Devon Drive, Chandler's Ford, and Sam McKinley, 25, of no fixed abode, deny murder.
