HE is only a minute from a savage beating and death.

This is the moment that newsagent Choudhry Zishan met the men accused of murdering him.

A murder trial jury has been shown CCTV footage that showed Mr Zishan, 35, on his way to work early on Sunday, March 30.

He met Jon McKinley and seconds later his brother Sam outside the Chamberlayne Arms in Eastleigh High Street.

The jury saw the three talk briefly and Mr Zishan, a father-of-one, move away as he walked to his car.Daily Echo:

 

Seconds later, the prosecution alleges, he was attacked by Jon and then Sam, leaving him for dead in the road with severe head injuries.

Jon McKinley, 23, of Devon Drive, Chandler’s Ford, and Sam McKinley, 25, of no fixed address, both deny murder.

Jon yesterday admitted punching Choudhry Zishan (below) but told the jury that he had not intended to seriously hurt him.

Jon said he thought that Mr Zishan was the man who had pestered his sister, Ellie McKay, earlier that evening in the Litten Tree pub in Eastleigh.

“Obviously it wasn’t. It was a case of mistaken identity,” he said.

Nigel Lickley QC, defending Jon, asked about a conversation Jon had in Fleming Park with a young couple who were with their baby at about 9am, when Jon talked about being a father, babies, Mother’s Day and breast feeding.

 

Jon said: “I ain’t got a kid, so I don’t know. I have a little niece around that age. I haven’t got a daughter. It was fantasy, I was drunk.”

He was asked about events after the killing. To many questions, he answered: “I don’t remember.”

Jon claimed that his injured right hand and foot, which the prosecution says stemmed from when he punched and kicked Mr Zishan, was caused when he was arrested by police later that morning in Monks Way, outside the flat of Emma Humby, Sam’s girlfriend.

Cross-examined by Andrew Langdon QC, prosecuting, Jon said that he would have felt justified in attacking Mr Zishan if he had been the man who molested his sister.

“But not the prolonged assault that you lot say,” he added.

Bill Mousley QC, defending Sam, asked Jon about the Fleming Park incident when he claimed to be a father. He asked: “Were you pretending to be Sam?” Jon answered: “I don’t recall.”
