Work on £20m Fareham and Gosport bus route can restart


A TOP judge has given the go-ahead for work to restart on a controversial £20m bus route linking two Hampshire towns.

The project, along a three-mile section of disused railway track between Fareham and Gosport, had been given the green light by planners last year.

The scheme was brought to a grinding halt when resident Vivienne Morge brought a High Court challenge claiming it would have a devastating impact on wildlife.

However, yesterday the Appeal Court in London allowed Hampshire County Council to carry on the work amid fears the authority could lose its massive Government grant.

Mrs Morge claims the planned route, if allowed to go ahead, would harm badger setts and the habitat of protected bat species that had found a safe haven in the vegetation alongside the abandoned railway.

She argued that the plan violated the EC Habitat Directive and domestic bat protection laws.

Mrs Morge, of Wych Lane, Gosport, initially lost her fight against the construction of the route when Mr Justice Walker dismissed her case on November 17 last year. However, on December 2, she was granted permission to appeal against that decision by Lord Justice Sullivan in the Appeal Court.

That resulted in a restraining order preventing the council from going ahead with works on the proposed route – other than minor exceptions – until after the appeal hearing, which is set for March.

James Findlay QC, for the council, applied to Sir David Keene, sitting in the Appeal Court, to vary that order and allow work to proceed, saying that the council stood to lose £20m in funding for the project if they wait until March to begin.

He told the judge that the construction of the route would take 15 months, and if not finished by the date of the funding deadline – March 31 next year – there was a “real risk” that the grant would be withdrawn.

Sarah Sackman, for Mrs Morge, claimed that the council was “exaggerating”

the time estimate for the works to be completed and also argued they could apply for an extension to the funding deadline.

But Sir David allowed the council’s application and varied the restraining order.

He said: “There is unlikely to be an impact on badgers or bats, other than a loss of foraging habitat, which will be very small.

“The loss is unlikely to have any significant impact on bats. The balance of convenience is clearly in favour of granting the variation now applied for.”

NOOOOOOOOO, please please please delay it, lets just all find an excuse to delay it till the deadline when the funding is withdrawn and the council will see no one wants a flipping guided bus way but a railway instead!!!

I agree with you and think that this is just a half-arsed attempt at solving the traffic problems which plague the town. A proper railway link offering services to Fareham, Portsmouth & Southsea and Southampton Central would be a huge incentive for commuters to ditch their cars. A rubbish bus link to Fareham, where people have to catch a connecting bus or train will not be. I remember reading somewhere that Gosport is the largest town in England without a national rail link. I'm not sure how true that is, but there's no denying the huge benefits a rail link would bring to the town. Sadly, those in charge are too incompetant to realise that whilst a bus link might be cheaper in the short term, the long term benefits of a railway link would be immense! Huge opportunity missed here and Gosport will suffer for many years to come as a result.

Or of course there could be a compromise and have a light rail system which could be connected to Fareham Station. They have done similar things in Croydon in similar circumstances and it worked; all it needs is a bit of track building because the land is all available and was the site of a previous railway line.

They planned a light rail system; the government refused to fund it and that was the end of that. So, in the typical local authority tradition of 'something needs to be done and this is something', we get this busway abomination.

Get a life people! Its happening so get over it. About time too. It wont solve the traffic chaos, any more than any other solution would, as the only solution would be to move Gosport! Now theres an idea! There will be plenty of room for it around the Fratton area soon....

Who in their right mind would choose to live in Gosport??

It is a dump and needs to be severed from the mainland and allowed to drift off down the Solent into the English Channel and thence into the big wide Atlantic, never to be seen again . . .

This is the same problem in Luton-Dunstable Railway ... Labour wants to build a guided bus away and the Conservatives want to build a railway and there is one man and about 100 people want to build a heritage DMU/Diesel Haled railway line. Apparently cause of this guys idea it is delaying it all and public interest is rising on the idea its delaying the guided bus way, he's already submitted the paper work from the layout to building it, which is causing a nightmare as they may have to now re change the guided bus way line.

I've made this polemical comment before in regard to this story, but thanks to the Barnett formula cash rich Scotland can rebuild a 35 mile heavy rail link to Tweedbank (population 10,000), relay Airdrie -Bathgate(20 miles), Stirling - Alloa (10 miles) and a new light rail system in an ancient city (Edinburgh) while the Treasury refused to fund even the short 8 mile phase 1 of South East Hants Rapid Transit System serving a population of 100,000. It would make a difference Ian if it wasn't for short term selfish political expediency from an inept Government that only knows how to fund bureaucracy. To compound the above all the prudence shown in the South East of England for decades was thrown away to bail out the suicidal risk taking of two Scottish Banks. Now we can expect to see more money pumped into Scotland to keep the electorate there from voting for independence, (paid for as always by the South). Scotland gets modern public transport strategies, we get a bus lane. The sooner that self-deluded self pitying country is allowed to cast itself off and go cap in hand to the EU rather than to us the despised sassenach the better.

I quite agree Andy; they have claimed devolution yet continue to vote in OUR Parliament and the two major players in the government are both Scots. If any of us wanted to become a Scots MP we would be debarred from doing so; in addition we are still being pushed around by organisations such as Sinn Fein who have seats in our Parliament, threatening to spit their dummies in Stormont.

In other words, the English nation is a target for p155 taking from all concerned; we must be the laughing stock of the world for what we are allowing to take place here in our name.-

It makes me laugh when people make these comments, I hope 20 years ago when Maggie ruled this country properly you weren't complaining. She never spoke to Gerry Adams or took notice of anything that was a waste of money. You're right, we are a laughing stock. We're paying enhanced Council Tax to pay for places like Leicester. When challenged John Denham said this was fair. Fair to whom? We have seen minimal infrastructural investment since 1997 yet are paying much more tax. May 6th can't come soon enough.
