Cancer sufferer Brianne Jones to sue Southampton General Hospital over quality of care
12:40pm Friday 18th May 2012 in Health
Exclusive By Chris Yandell, Chief Reporter, New Forest
SHE is barely out of her teens but has been given only months to live.
Now cancer sufferer Brianne Jones is to sue the NHS for what she claims was a catalogue of missed opportunities that could have saved or prolonged her life.
Brianne believes doctors could have diagnosed her earlier and that medics even “lost” crucial blood samples that could have led to earlier treatment.
Brianne, 20, is also urging other young people to monitor their bodies for any signs of cancer and insist that they receive proper treatment.
Six years after first raising the alarm, she has tumours in various parts of her body, including her brain.
Much of her criticism is aimed at Southampton General Hospital which, she says, has failed in its duty of care.
“I feel very let down by the NHS. I just get the feeling they think I’m a lost cause,” she said.
Last year friends launched a fundraising campaign after learning that she was terminally ill. With the help of generous Daily Echo readers they collected enough cash to send her on a tour of Europe.
Now, with time running out, the young hairdresser is vowing to fight for justice.
Brianne is planning to sue Southampton General Hospital for compensation but knows she is unlikely to live long enough to benefit from any pay-out.
Instead, any money will be given to her eight-month-old niece Aimee Louise Smith.
Brianne, of Marchwood, said: “I always intended to spoil her and compensation would enable me to do that, even if I’m not around to do it in person.”
But what she really wants, she says, is a public admission that doctors failed to provide her with adequate treatment.
Brianne’s nightmare began in 2006 when a mole on her ear began bleeding. It was removed at Southampton General Hospital a few months later but Brianne says her ear took two years to heal.
Last year she developed a range of alarming symptoms, including unusual bowel movements and lumps in her arm, thigh and breast.
“I explained that I’d had a mole removed five years before and was getting worried by my continuing health problems,”
she said.
“I clearly wasn’t well but noone was doing anything to identify what was wrong.”
She had two spells in hospital in January and March 2011 after which she was diagnosed with irritable bowel syndrome.
But the problems persisted and she returned in August when they tried to perform a colonoscopy but were unsuccessful due to a blockage in her bowel.
During this time blood was taken for examination.
Brianne also visited her GP on three occasions in May, June and August as lumps began appearing on parts of her body.
Then in September last year Brianne went to A&E at Southampton General Hospital with severe stomach pains. She says she requested a scan but was told to take painkillers.
It was when she again went to her surgery later that month to talk to her doctor that it was revealed that the blood taken earlier in the year had either never been tested or the results had been lost.
Her world finally fell apart at the beginning of October – in the same week as her 20th birthday.
Following more blood tests and a biopsy she was told she had melanoma, the most deadly form of skin cancer. It had spread to other parts of her body.
“To be 20 years of age and told you have only six months to live is indescribable,”
she said.
Two months ago she had a huge tumour removed from her abdomen, but others remain.
Dr Michael Marsh, medical director at University Hospital Southampton NHS Foundation Trust, said: “This is an extremely difficult time for Brianne and her family.
“We will continue to provide them with any support, advice and assistance they require during her ongoing treatment.”

However has this girl realised she is not suing the NHS, she is just creating another cost for the taxpayer, if there was no FREE HEALTH SERVICE, what would she have done? Died already? Would her parents have sold everything to get private treatment? The NHS day's are numbered as it is, in ten years will we all be suing the government of the day for providing NO healthcare?

I am quite sure her beautiful little niece would rather remember time spent with her loving Aunt, than snatched visits between an Aunt who has something else going on in her sadly short life ....
I can only say I wish her all the best in whatever she decides to do.

If anyone is to blame, it is the general public who want something for nothing all the time. And we vote in governments who make foolish attempts at giving us that. Until we realise that we must contribute so much more money to national interests like the NHS, we will see more and more people like Brianne.
Deepest sympathy to Brianne and her family at a most difficult time.

When it was first set up, the NHS was affordable. We had doctors, nurses, and hospitals, and some basic equipment. Now we have scanners and all manner of advanced equipment and medication, which all has to be payed for, including the training for its use. If anyone is to blame, it is the general public who want something for nothing all the time. And we vote in governments who make foolish attempts at giving us that. The problem with cancer is that, it needs to be diagnosed early, to 'kill' it. Sometimes the symptoms don't show until it's too late. I fear that this young lady doesn't stand a chance of suing them, as they couldn't have saved her from it.

when she had the mole removed did they check her out & make sure they got it?
was that the start?
did no alarm bells ring in her doctors?
who lost the blood samples? why was she asked to give more straight away?
This is a catalogue of errors it has nothing to do with cut backs but it seems to have much to do with not diagnosing the cancer sooner.
could this lady have been cured if those blood samples weren't lost?
if they're saying if they caught it sooner they could have treated it then the cutting out of the mole should have had an in depth examination to make sure it hadn't spread so that's the person(s) to sue then look at the blood dept.
I hope this Lady has a great time with the rest of her life & wish her to enjoy the time she has left

There are 2 sides to every story and for people to queue up on here to criticise the N.H.S purely on the basis of what they have read in this article is short sighted to say the least,it may come as a surprise to some but doctors are not magicians or fortune tellers but human beings that use their skills as best as they can to identify and cure our ills, you can't always get your car fixed so why do people expect a doctor to fix something as complex as the human body. Yes its a shame she is dying but she has had 20 years and a lot die younger, nobody wants to die but thats life and suing the N.H.S is only taking funds away from other patients. I am not saying that mistakes have not been made i don't know, what i do know is that the majority of people receive good care from the N.H.S but you never hear about them because they are happy, its only the ones who are not happy that bother to make comments so a few more comments from the happy ones and a few less from those that are less than appreciative of our N.H.S would go a long way to boost the moral of N.H.S workers.

Sadly in these reported cases, we have not had ALL of the story, only the one told to the DE. This lady can sue the Hospital and then we can judge all concerned once the case is decided. I hope the Lady is here to see the result.
'Stupideditor' how can you say that this is a clear failing of the NHS when you don't know the facts. Ten years ago I had breast cancer and I can't sign the praises of the General Hospital enought. Once they discovered abnormalities I was in and out of the hospital for a weeks having various tests. I think it fair to say that some cancers are easier to treat than others and unfortunately skin/mole cancers are more often than not very advanced and have spread deeper before any change is noticed. Very unfair to blame the hospital, we are lucky to have a free Health Service, my friends in Australia have to pay extortionate amounts of money to see a Doctor, visit the Dentist or go to Hospital.

That's not to say that failings shouldn't be highlighted in order to seek improvement. But with millions of people being diagnosed and treated every day, things will inevitably go wrong sometimes.

The unfortunate truth is that medicine is not the exact science that the public think it is. Yes, given limitless resources we could test everyone for everything on a weekly basis, but that's neither practical or affordable. Instead, doctors have to make risk-based judgements - and sadly they will sometimes be wrong.
