Southampton will not be able to appeal against Football League's point deduction


THE Football League has decided to refuse Saints the right to appeal against the 10 point deduction.

The League has informed Pinnacle of it's decision, and subsequently released a brief statement.

As a result, it leaves the Pinnacle deal in jeopardy, and as such could place the very future of the club in danger if none of the other bidders step in.

The full statement from the Football League reads: "The Board of The Football League met today to consider representations from the 'Pinnacle Group' with regard to their proposed takeover of Southampton Football Club.

"The Football League has the responsibility to ensure all League clubs start the season with certainty as regards the competition they compete in.

"With that in mind, The Football League has responded directly to the Pinnacle Group, and will continue to liaise with their representatives going forward. "

Ok, so the FL are not allowing the appeal. I wasn't expecting they would, tbh. I just hope that Pinnacle now accept the decision, the deal is sorted out and that we have a club in the league this coming season. With a good run of results the deficit can be wiped out early and if the team play well, relegation won't be an issue.

This means the FL KNOW that if it went to the High Court, they would LOSE.

Therefore, they are trying to bully Pinnacle into a corner by making them accept the -10 points before giving them a licence.

In summary, the FL would rather Saints go bust, than even allow us the right to appeal a decision.

Not trying to be funny and everyone hates a smart-arse, but I said from day one, it was never going to be resolved today. The league were never going to just roll over and if Pinnacle wanted to take it further it would involve high courts and maybe even European! All will take time.
Now the question everyone is asking, will they still go for it! How badly do they want the club!

Outrageous, but what should we expect from Mawhinney and his dictatorial regime. Surely it is democractic to allow some form of appeal - in any other walk of life, or professional body, an organisation would be allowed this fundamental "human" right? But no, as the FL know that their position on Sains does not hold up in law.

I just hope that Saints live to fight again, and further I hope that the great work that Tony Lynam, Matt Le Tissier etc. does not go to waste and Pinnacle still do seal the deal.

Who knows, perhaps we'll meet Lord Mawhinney again later this year in the play-off's and he'll get to hear exactly what 50,000 Saints fans think of him and his undemocratic organisation!!!

you are actually right.I have many years working for a intnl law firm and i would tell Pinacle that the league decision is not binding upno the club even if waiver signed. I hioe the Le Tiss and mystery backer can forget about the 10 points its just not worth figthing over - if the club went to court and somehow lost the decision which they might we could end up with a further 17 point penalty. Think Leeds.

I think you will find the Jackson bid aren't after KK as manager rumours are Peter Reid.

I don't think Pinacle will pull out i just think they wanted to try to see where it got them. MLT will not let them just walk away he loves this club just as much as the fans

I just got an email from the FL. There is clear reasons for appeal none of which apply to Saints. The fL are unfortunately in their rights to refuse. This is Ruperts last laugh if he took us into admin a few days before our -10 points would have been applied last season.
Come on Pinnacle just agree we can go up anyway.

I'm sure Pinnacle had already discussed this eventuality and (hopefully) made their mind up to continue, they just felt they had to try. I expect they would have been as surprised as anyone had they succeeded.

If the decision is how it is described it means that it's not up to Pinnacle to accept the decision as a condition for purchase.

They can purchase and then take the Football League decision to court.
Not an attractive proposition maybe, but a possible one which will allow things to progress.

I tend to believe that the decision was predictable.The league failed to close the administration "loophole" and know that they would lose if Pinnacle appealed.We now have to wait to see how much the consortium value the club,are they prepared to take on the legal costs for an appeal,these could be quite heavy.Perhaps they were playing a poker hand,intending to proceed anyway.I believe that without the points deduction we would achieve automatic promotion,but the 10pts is quite a handicap which could bring in the play-off scenario.It's going to be interesting to see what the football/financial/l

ONE. We DID have the right of appeal (League Rules - in writing, within 7 days of the decision.) Nobody at the club submitted an appeal. So why should an appeal be allowed 3 months later?
TWO. An appeal process would take months. So why should league positions be jeopardised later in the season by -10 or not -10 worries. It is for League stability, not face-saving.
THREE. Administration is administration. SLH or SFC, it matters not. The fact that the club are struggling to find cash to pay salaries is confirmation that the two entities ARE linked, so the original decision was correct and in line with other points deductions.
FOUR. You didn't scream and whine when other clubs got point deductions. Saints are NOT "special". Saints are a club like any other.

LETS JUST TAKE THE -10 AND CARRY ON. Do you honestly think that -10 points guarantees relegation? If so you need your head testing!

It may be unpopular to say so on here and I expect abuse for making the point BUT
If you read the football league rules you will see that the ECHO and others have simplified the points about administration and also the appeal rules. These rules have not been simply dreamt up by Lord M, they have been voted on and approved by the clubs, Saints included. The rules set out a number of conditions relating to clubs being insolvent, the "we are not in administration it`s the holding company" point doesn`t hold water. Also the rules set out the grounds for appeal and time limits and Saints don`t meet the criteria. Pinnacle must have known this ?? They must have considered all this very early on?? Did they really ask the League the questions last Thursday as reported in the ECHO??

I think we all knew what would happen today. Does anyone really believe that Leeds haven't had top lawyers looking at their situation previously? We must now take the 10 point deduction, sell season tickets and prepare for some football. I would be very disappointed if Pinnacle now use this as a cheap excuse to pull out, when all potential buyers must have known we were almost certainly starting on -10 before they got involved.

Why is it that we were deducted 10 points based on the worst scenario, i.e. if we avoided relegation the deduction would have taken place last season sending us down, or as happened, we went down anyway so the points are deducted next season, yet Stockport went into admin AFTER we did and they had points deducted for last season? As a mid-table team the points deduction did nothing to penalize them. Why don't they have to start with -10 next season like us? Funny thing is, we are in the same division as them, so we've been hit with a double punishment in my estimation. If anyone knows please let me know. I suspect the League is totally clueless as to why. Maybe the Echo can actually investigate this story instead of continuing to speculate about the new owner and new manager.

Saints aren't and shouldn't be a special case. Many teams have been docked 10 points for going into administration, none of them had the right of appeal. The reason the FL can say you cannot appeal is because the FL is a members organisation, everyone agrees to the rules before they are allowed to join. Leeds tried to appeal to the court of sports abritration (I think) and it was rejected because they had agreed to the rules. Rupert Lowe even held Saints up as the correct way to run a club when Leeds ran into trouble.

Furthermore, if Saints can't get a CVA agreed they may end up with another deduction!

Isn't it about time that Pinnacle went to the courts to clarify the point in question. Time is surely running out. In the past there have been issues over similar situations and it makes me feel that the FL are somewhat nervous. The right to appeal should be available to all and I believe it is irrespective of being a football club or private individual.

So far as I can make out it isn't a question of the league not allowing SFC to appeal. Having read the rules that were posted over the weekend the grounds for appeal don't apply to SFC's situation. What they should be saying instead is that the league want SFC to agree not to challenge the league's decision through the courts the reason being that the decision was contrary to the league's own rules.

You are wrong! If you read the rules the grounds for appeal dont cover SFC's position. Sfc's argument is that there is nothing in the rules to allow the league to do what they did to us. In that respect we have every right to challenge the league's decision to dock us points and the only way they can stop sfc doing that is to extract maximum leverage out of the situation and make us sign an undertaking not to issue a challenge through the courts. Talk of appeal is therefore misleading.

I am pleased to see there are some people posting on here who have actually read the Football League rules and realised that the stuff the Echo has been feeding the easily led over the last few days/weeks/months is over simplified guff designed to sell newspapers and pander to those who see the world through red and white tinted spectacles. The League is a coming together of the member clubs (which used to include Saints, at present still does) The clubs decide on the rules, who sits on the committee and who is Chairman. That`s the way it works. Saints do not have a given right to be a member of that organisation, Saints fans have no right to expect that Saints should be treated any differently to any other club. Saints are not a "massive" club, they do not "deserve" to be in a higher division ,they are a third division football club with a nice stadium built on debt they couldn`t afford to service. They have consistently employed players on wages the club could not afford, look at the accounts. The League is trying to maintain fair competition which cannot happen if clubs take on debt they cannot pay back in order to pay players who they otherwise could not afford.

This ranting about the FL might be all unneccessary. The statement suggests not strong arm blackmail but a dialogue about moving this situation along more promptly than a lengthy legal challenge.
As another poster has said, the FL is an amicable coming together of clubs for the purpose of staging a competition. There has to be rules, there has to be authority, or we can go play by ourselves! I would imagine there would have to DEADLINES too. It is not just an institution's or an individual's pride or malice (as some think can be attributed to Mawhinny) that leads to rules on deadlines. Our 'administration' has dragged on for months without a successful appeal. The FL would prefer an amicable resolution prior to the league kicking off. They probably want to know upon what grounds Pinnacle would appeal - just wanting the points is not enough - and then they would tell us whether to pursue it. It probably as a much more stepped and organic process than an episode of Judge Deed! Governing bodies think the spirit of the competition is maintained by NOT going through the courts. Do you think Luton fans should be able to appeal now and ad infinitum? How about Sheffield United fans for their relegation 2 years ago, or German FA for a world cup final etc etc

I think that the football league are being stupid. We have every right to appeal to get the points taken off seeing as it was our parent company that went into admin not the club the leauge should take the points off

in all fairness you should be allowed to appeal, but what do you honestly hope to achieve? They wont change the points penalty as your red faced clown tried to be clever and buck the system. Who can honestly say that the holding company and the football club were not one and the same. I understand why you are all angry but lets concentrate on the football and getting out of league 1 - Pinnacle buy us up!

Oh yes, how hypocritical. With all respect to your fans and what they are going through - and by god you have a few years of frustration ahead before things move forward - but just like Luton, how you enjoyed and embraced the demise of LUFC with your club voting against our own case, when they knew little of what was involved.

I'm surprised there isn't more concern regarding the possible extra 15 point penalty if the Saints exit administration without an agreed CVA - which they surely wont if more than 25% of their debt is to the Taxman - as Luton, Rotherham, Bournemouth and Leeds have all had that penalty imposed so far..
