New signing Davis refused Saints clearance
3:44pm Monday 9th July 2012 in Sport
By Adam Leitch, Chief Sports Writer
Steven Davis
New Saints signing Steven Davis has been refused international clearance to join the club.
Davis was one of a number of players at Glasgow Rangers who refused to have their contracts transferred to a newco Rangers, and therefore felt able to leave on a free with their deals effectively terminated.
The Northern Ireland captain agreed a three year deal to move to St Mary’s, but the SFA have refused to grant the required international clearance for the switch to be ratified.
The SFA have to contact the selling club to get their agreement for the transfer and Rangers have objected to the move of Davis, and several of his former colleagues who have also agreed deals to join other clubs after leaving the beleaguered Ibrox outfit.
Saints are able to appeal to FIFA for a temporary licence so Davis can remain with the club while the world governing body make a ruling on the situation.
When contacted by the Daily Echo, Rangers confirmed: “The SFA have already confirmed that they will not release an International Transfer Certificate to any National Association that requests it and have referred the matter to FIFA.”

In addition, apart from the fact that his employment contract was with a now defunct company, the new entity cannot guarantee him the standard of football he was used that paid a salary at that standard.
I don't think that Saints have a problem and that their legal eagles will have thought this through.

Surety there is no case to stop Davis joining Saints as the entity he was employed by has ceased to trade and futher cannot continue to employ him in the previous manner that he was used to.

The other matter is whether Rangers FC are entitled to a transfer fee. This will depend on Davis's contract and on FIFA/SFA etc rules.

A bit like when, the league insisted saints where in administration and we nearly didn’t get the an agreement to play in the league because we couldn’t provide we had come out of administration because we hadn’t actually gone into administration!
As usual, the football bodies will have to make something up. I imagine that it may involve minimal fee's changing hands too smooth everyone’s feathers. Maybe some white pudding and a deep fried Mars bar or two.

They gave SPL clubs the veto on Rangers (newco) remaining in the SPL, the other clubs kicked them out of the SPL, then they are allowing the SL clubs too veto which league Rangers newco can join, which will probably be the third tier of Scottish football.
Then the SFA expect the players who have not been TUPE'd over to Rangers newco to remain with them, absolutely pathetic.
This is going to get interesting, employment law will be bought into it, I'm pretty sure that anyone (including the tea lady) who has not signed for the newco or been TUPE'd across to the newco are to able leave any company as they're without a contract.
Clearly the SFA are now trying block players leaving Rangers newco, which I don't think they can do.
By passing it to FIFA they are passing the buck as well, all of this situation with Rangers newco so far has shown the SFA cannot or will not make a decision.
Once Blatter and his cronies gets hold of it a decision will take ages, leaving all the players and potential purchasing clubs in limbo.
I feel a test case coming on, hopefully the court of sporting arbitration will be on stand by to sort this mess the SFA have allowed to happen out.

Davis is Northern Irish what the hell has international clearance got to do with them surely not as he is not a scot. When a player is transferred internationally clearance is obtained from his governing body and in Davis's case that is Northern ireland.Or are these not the basic rules?

The situation is that all Rangers asked was that players transferred to the newco and then they would allow them to transfer at a very low figure, in the case of Steve Davis the figure is about 1.6m.
Personnally I believe that is a very reasonable figure for an extremely good player.
What is now happening is that the Scottish F.A. have been asked by Rangers not to release the international clearance that is required in any and all transfers, until they have been able to negotiate some sort of fee for any player who wishes to leave.
Norwich have paid a fee for Robert Fleck and the transfer has gone through.
This transfer will happen, after some sort of negotiation, and I imagine that Saints were well aware that this would be the case and have prepared accordingly.

the general opinion is that tough on Rangers but so what !
My point is that all these players were offered a get out that favoured the players and was extremely generous. Rangers are skint and would have sold Steve to us no problem.
Currently they have a squad that is extremely thin and no money to replace the players who have left, much the same situation as Poopey.
Sympathy is rare, most other Scottish clubs are gloating at the demise and slapping each other on the back at getting them chucked out od the SPL.
The most often repeated phrase is "sporting integrity".
Now that Rangers have said they want to go to the 3rd league and the tv money will be affected, these clubs are not quite so sure as they will lose a small fortune and now they want Rangers in div 1 .
Whatever league they end up in they need players or money to buy them.
It is my expectation that Saints new all this and have done the first part of the transfer knowing that a small compensation will be due.
When they know how much I bet they go back and get McGregor.

Temporary clearance can be granted by FIFA to allow them to play while others argue the toss.
He,s our player, and no-one can blame green for trying to get some compo-but cant see that happening.
Paperwork needs to be signed by old rangers before a player can be allowed to leave (normally),but soon they wont exist so the contracts are null and void unless a player agrees to transfer it,they have been told legally they dont have to.

Looks like all concerned are just setting our their position ahead of the bargaining. The SFA = The old firm and they understandably would like to see some cash for the player, but in the mean time Saints secure Steven's signature ahead of rival bids and the player can train. If FIFA don't let him play, then he can take them to the European Court of Human Rights. They'll get it sorted out in no time.

The players took up to a 75% pay cut in Feb on the understanding that the Club would be free of debts via a CVA in July. They would get a reduced transfer fee clause as a thank you.
Turns out there was no CVA & the Club was effectively liquidated. The Newco didn't follow TUPE rules or timescales, and didn't even bother to keep the players informed. They merely told them they now worked for Newco. They couldn't tell them what League they would be in or guarantee their wages would be put back to normal.
This is a scare tactic to get any money they can. They have various other threats doing the rounds as well. All will fail.
Nobody has asked Rangers this question. If the whole Scottish League will face "Armageddon" should they be put in Div 3, how come you said a few years ago that Rangers/Celtic joining the English set up would actually BENEFIT the SFA ?
95% of Scottish Fans want them in Div 3. The vast majority of their own agree BUT not for "sporting integrity" reasons. They believe the rest of the League will crumble without them & see it as REVENGE. Even Saints are on the Rangers fans forum "hit list" because you cancelled the tournament !!
They are full of sh1t & believe me, there is FAR more to come out.........

Once Ranger are allowed in League 1 or 3 the SFA will ok it. Then Rangers can start their futile attempt at claiming compensation. It is just a formality and the SFA protecting itself from legal action from Rangers. #Farce
The team once known a Rangers still excist for the moment ,once liquidation is formal ,there won,t be any problem.

Green has already transfered the clubs assets including Ibrox and the training ground from the newco (that bought the club in administration) to another company. He didn't even bother to speak to the players concerned about what company they would be transfering to. He just threatened them with legal action. That is all Rangers are at the moment, a company, not a club. They don't belong to any league. The whole thing really is a farce.
As I commented on Saturday, I am a Rangers fan as well as a Saints fan(long story) . I hoped that Saints would offer some sort of compensation as Rangers really are deep in the doodoo.

My comment that Saints were probably aware of this has been echoed on the Norwich site as they have also signed an exRanger. the general opinion is that tough on Rangers but so what ! Different topic, Brum goalkeeping coach has joined Norwich and they think that they could persuade Butland to join even with Ruddy there !
