Saints to fight Benali court case
8:06am Thursday 7th February 2013 in Saints News
By Gordon Simpson, Senior Sports Reporter
Francis Benali
Saints have promised to “rigorously defend” themselves against legal action being brought by the club’s former player, Francis Benali.
Benali, who made more than 350 appearances during his Saints career, is suing the club over a “lease dispute and lost ambassadorial fees”.
Saints confirmed the action in a statement relating to the cancellation of a meeting between chairman Nicola Cortese and ex-player Matt Le Tissier.
The club called off the proposed talks, which had been reported yesterday, after Le Tissier spoke publicly about them.
Le Tissier had revealed he planned to speak to Cortese about Benali, who he said is “banned from the football club”.
Saints, in their statement, said: “Mr Le Tissier refers to his friend Francis Benali having the best interests of the club at heart, while neglecting to mention that the same person is currently suing Southampton Football Club in relation to a lease dispute and lost ambassadorial fees.
“It is a legal action the club will be defending rigorously in the best interests of the club and its reputation.”
Benali was unavailable for comment.
Le Tissier, who has been publicly critical of Cortese, had been due to meet the chairman at the end of the month, with Saints telling him the venue would probably be in London.
However, after confirming to the Daily Echo that talks were due to take place and discussing what he hoped to achieve from them, the club announced the meeting was being cancelled.
Saints accused Le Tissier of “a breach of good faith”.
The club’s statement, in full, read: “A meeting was organised between Nicola Cortese, the club’s executive chairman, and Matthew Le Tissier in what the club believed was good faith.
“Both parties had agreed that it would be a private meeting with no publicity surrounding it, yet within 24 hours this matter was put in the public domain and further negative comments attributed to Mr Le Tissier have appeared (yesterday) morning.
“As an ex-player, Mr Le Tissier’s achievements are well known.
“However, his repeated criticisms over a prolonged period of time are not justified and have not merited any response from the club. Nor has the motive for these personal attacks ever been made entirely clear.
“Mr Cortese wishes to reiterate that he will not make comment about somebody he does not know personally – and that includes Mr Le Tissier.
“These criticisms have not affected the club’s success and progress on or off the pitch in recent years and will not divert the club from its course in the future.
“For Mr Le Tissier to agree to meet ‘in good faith’ and then make such comments can only be seen as a breach of good faith and certainly not in the best interests of the club.
“Mr Le Tissier also refers to his friend Francis Benali having the best interests of the club at heart, while neglecting to mention that the same person is currently suing Southampton Football Club in relation to a lease dispute and lost ambassadorial fees.
“It is a legal action the club will be defending rigorously in the best interests of the club and its reputation.
“In all the circumstances and in light of the comments attributed to Mr Le Tissier, the club believes that it is now not possible for the above mentioned meeting to take place in good faith.
“We would nevertheless encourage Mr Le Tissier to join with our fans and continue to enjoy the success the club has achieved over the last three-and-a-half years.
“The club now considers this matter closed and will not be making any further comment about it.”
Le Tissier said on his Twitter page that he was not surprised the meeting had been cancelled.

I have it on good authority, that Cortese rented a house from Benali when he first came to England. Cortese proceeded to carry out works to the house without permission. The house was left looking like a building site. This is why Benali has taken court action.
I think that Matt is in a LeTiss because Cortese beat his consortem in buying saints and its sour grapes from his part.
Even if we won the league, had a £100million profit per season, had Messi and Ronaldo in our team I think letiss would still critise 'The Don' saying hes running the club into the ground.
Get over it Matt and let us think of you as our childhood hero rather then a someone trying to upset the apple cart.
Some things i dont agree with at SFC but for the majority of Corteses reign he has dont an excellent job.
Prem in 5 yrs he said, we did it in 3...and we have a superb youth set-up and a ever improving team that has pretty much stayed together (for the most part) since league 1 therefore im happy.

As for the ambassadorial contracts, several players were on big money they were still drawing when we were in administration with no money. Contracts cancelled when Markus took over, so grounds for a legal dispute. Benali knows he is best served by silence and letting the courts decide.
Tiss is entitled to his opinion, but as a public figure he should be careful what he says.

I don't know where you stand when your employer is taken over...suspect it varies with type of contract. I have heard (again hearsay) that ex-players carried on taking money when fans were fundraising. Or perhaps they didn't and Benali now considers it a debt that should have been paid on takeover (as all other debts were paid). It will all become clear in court.
The court case about the house involves SFC as they no doubt took out the contract...quite common for temporary houses to be rented for executives and other emloyees. Until quite recently the club rented houses at Ocean Village for newly arrived players.

The consistent message from the club is that they have a plan and serious ambition and nothing should distract from this.
Pitiful strops like this, which make it to print just show you how far away from the St Marys and reality, the Daily Echo has become.

The coverage does the club and supporter morale no good at all. But it does attract a lot of attention to Matt whose new celeb career feeds on publicity.
It really does sadden me to say so, but Matt could learn from Cortese who seems to know the precise psychological moment when to say nothing.
They should sort it out quickly. My wife and I always come to terms very fast. Hers.

Btw I'm glad so many of the fans are adopting a sensible approach to this silliness and are advising Matty to cut it out. That's putting the club first!

They did a vote and most people agreed that Cortese's was right in this instance.
So quote the facts from a different angle and headline as if the club are hounding Franny.
In this instance, again. The Echo are way out of line.
Why are they surprised their readership has dropped?
When the senior editor was relieved of his duties there was a deafening silence, unlike the same incident with Nigel which they still bring up regularly.

We all love the players of the past who done their job on the field. But that dont mean we have to take sides in any other matters that arise between them and the club. May i suggest that those that dont want to stand shoulder to shoulder with the club, take a look at themselfs andsee if they really want to support the club or go drinking with playes of the past.

MLT fantastic years with the club respect to that and the loyalty. Your gob is making you look like a petty vindictive individual. That is not the guy I met and talked to on occasion. Please back off, its your credibility that is being damaged.
FB a good solid pro for the club. Always 100%.
NC comes up against the media because he does not jump through hoops when they order it. Does not give out all the gossip, so they look to damage them.
Another disgrace Echo again showing your true colours of anti Saints agenda.
And on something that is not news, this case has been knocking around for ages.
NC is right to cancel the meeting, there are people who would like NC out because he does not suit their agenda.
Does not pander their every need and want.
Whilst MLT may have kept this club up on a few occasions. NC saved our club from extinction. Sorry I want NC at this club, he is good for the club determined and focused.
SKY did away with family clubs, they are history at top level, Its all business and has been for 2 decades. It died out at saints with Ted Bates and gentleman John Corbett.

Man City have looked fragile due to the lack of their backbone in the last month. Will Yaya Toure and Vincent Kompany return in time to put it right at St Marys.
Liverpool totally out passed Citeh last week but if you make one mistake e.g. Reina and then their quality will punish you e.g Aguero.
We have the mentality, belief, style and fans required to take out the first scalp from the top 4 this weekend. You may wish to consider and think.
Belated message to Strassie, the goals on that wonderful historic Aussie night were scored by goals Tony Popovich and Harry Kewell.

I have it on good authority, that Cortese rented a house from Benali when he first came to England. Cortese proceeded to carry out works to the house without permission. The house was left looking like a building site. This is why Benali has taken court action.

Yep same story from a totally different perspective, and has no bearing on this matter. Frannie and the club have a legal dispute, obviously why Frannie is not available to comment. I can understand NC point of view when it comes to the media, things do get taken out of context for the benefit of a better story for the papers.
Fella's do us all a favour, sort it out in private, all you have to tells us is that you have shaken hands and the matter is closed...!

Just asking.
Sorry I would argue Saints position till I couldn't talk any more.
I went & saw Bennet Benali & all those Saints teams before the FA Cup win & after.
I remember going to every away game the year McMenemy took over & we got relegated & I still went to every away match.
I remember standing under the east stand looking up & seeing the seats empty yet I was called a yob.
I would never consider suing the Saints over a private matter & to compare it to some one deliberately knocking you over is sick.
After the years of the board selling for as much as they could get to Rupert Lowe & the devastation he wrought then to go through all that only to be saved from Pompey's fate by Cortese's insistence to the Liebher family( Hope I spelt that right) I can't believe how many fans are so against Cortese?
Fine let an average footballer hang on to the apron strings of Saints & make a packet through appearances & interviews then sue his very bread & butter for more money.
Just what would happen if the company say's enough's enough & pull out of Saints?

Oh and as for your comments about arranging a fight etc, I think you'll find you are the only one who's mentioned it.
I'm only telling you where I'm going to be.

Just look at the photographs of Matty, Franny and Cortese and honestly ask yourself, who looks the shyster, could it possibly be the Michael Corleone look a like ?
Cortese didn't have the guts to face a news conference on sacking Nigel and hasn't the guts to face Saints legend Matty.
The shyster has got a poor court record played two lost two!

A lot of passion and divergent views shown on here from what is sadly a relevant topic involving SFC, fair enough. I don’t think that much in the way of news is fresh from the blog yesterday so my views still remain.
I’ll share you a few off-topic thoughts in my head as a side show:
Man City have looked fragile due to the lack of their backbone in the last month. Will Yaya Toure and Vincent Kompany return in time to put it right at St Marys.
Liverpool totally out passed Citeh last week but if you make one mistake e.g. Reina and then their quality will punish you e.g Aguero.
We have the mentality, belief, style and fans required to take out the first scalp from the top 4 this weekend. You may wish to consider and think.
Belated message to Strassie, the goals on that wonderful historic Aussie night were scored by goals Tony Popovich and Harry Kewell.
Bring on the Ashes, mush.

Benali & LeTissier owe there whole standing in life through the Saints.
Benali was cr+p LeTissier brilliant.

As Nicola would say himself, this is business and, in business, if you let somebody walk over you you get what you deserve.
I'm not against Cortese in the slightest, but I honestly don't believe Benali would be suing unless it was the absolute last resort. And in all the year's I've seen the guy, I don't view him as someone who chases the money. He is a decent, nice guy who loves the club.
Same is true of Matt.
Forget the amount of people who are against NC (not many in my opinion) but personally, I can't believe so many people are willing to jettison the views of people we have seen associated with the club for decades to blindly cosy up to a guy we know very little about, mainly because he likes to manage the media.

As a football club Saints are in a very emotional business.
I was there when Franny scored and chanted his name as loud as anyone.
I saw him and Le Tiss on Saturday morning Sky with Lovejoy quite a long time ago. I thought then that I couldn't see what he was moaning about. The carpet got damaged and replaced with a proper timber floor. A real expensive floor, not some cheap B & Q laminate.
Get over it I thought at the time, still do.

Yeah time to move on. A nice positive new thread form the echo would do the trick. How about one about some of the injured players making progress to full fitness or something like that. You know, football related threads.
Also, how about he echo getting rid of obvious trolls and wum's quicker in future so decent Saints or proper football fans don't end up retaliating and then getting their wrists slapped by the echo for doing so. Prevention has always been the best cure hasn't it?

As a football club Saints are in a very emotional business.
I was there when Franny scored and chanted his name as loud as anyone.
I saw him and Le Tiss on Saturday morning Sky with Lovejoy quite a long time ago. I thought then that I couldn't see what he was moaning about. The carpet got damaged and replaced with a proper timber floor. A real expensive floor, not some cheap B & Q laminate.
Get over it I thought at the time, still do.

why on earth should a meeting between MLT and NC be kept secret ? I can think of absolutely no reason. The meeting would obviously be minuted/recorded ( otherwise it would be pointless ) no one in their right mind would agree to a gagging order on such a meeting since the issues raised would be about the character of each individual and the doubts each of them has cast on the other. So the only conclusion I can see is that this is a smoke screen and set up..... and/or NC just has not got the b&lls to meet Matt face to face.... Perhaps he thought playing a personal disagreement out in the media was a little, shall we say, lacking in class?
Perhaps he wanted to hear exactly what MLT had to say and why he had a grievance in private before any possibility for media propaganda?
Perhaps he thought that making the meeting public would make it look like he was trying to gain positive PR from a personal situation?
Who really knows? Not you, I guarantee that.

I have it on good authority, that Cortese rented a house from Benali when he first came to England. Cortese proceeded to carry out works to the house without permission. The house was left looking like a building site. This is why Benali has taken court action.

The argument about the house is apparently that SFC claim the deposit covers any damage caused. Originally reported that a carpet was replaced with a wood floor...now story getting added to...few of us know, so best not to speculate.
Its Funny how Dodd seems to have a good relatinship as he is actually playing a role in developing the club.
I have no problem with Clause raising his profile by somehow involving himself in the aquasition of Forren but Le Tiss just doesnt present himself well at all.
Cortese has come out of this looking rather well in my opinion. He gave him a chance and Le Tiss made a twit of himself!

I'm so looking forward to yet another rehash of it all tomorrow.
There will be a picture of Cortese (I think its his turn) and a heading "The man behind the Myth - What makes Nicola Cortese tick" The real reason he doesn't meet Le Tiss , the true story of how Benali was conned by Lawyers R'Us to sue the club.
This will be followed later by other expose stories "why is Terry Paine hiding in South Africa" the truth about his involvement with the great train robbery.
The truth about Ted Bates - why he is never seen at St Marys - at last the Echo has the facts !!
The truth at last .. why Ali Dia turned down a five year contract at the Dell.
The truth about Mick Channon's testimonial - new fixing scandal - how Stan Bowles and Mick put one over the bookies.
Why Le Tiss stopped betting on the first throw in - too many people were betting it would be him that put it into touch !!
Why Ron Davies may never play for Wales again.
I can't wait .. but please .. no more about "meetings with Cortese"

Le Tiss, we know is all heart, and so is Franny. It is tempting to say move on from the bickering for the sake of the Club. However some things are more important than whether the club is in the Premiership or the Championship.Le Tiss I feel sure would always stand against the school bully. I feel sure too, that he is Southampton through and through. A Southampton boy who happens to come from an island with close ties with our great city. Le Tiss values people above money. Mr Cortese probably would not be able to understand those values. However Mr Cortese has to understand that a large part of the equity of the club he controls is a indefatigable human spirit, that is based upon generations of supporters and players. Mr Cortese will never be the chairman he longs to be until he recognises the value of people, and appreciates that football support relies on history, and relies on the people that made history. Le Tiss,Benali, Jim Steele; supporters like my dad (now deceased), your dad, grandfather, uncle etc and countless others are Southampton FC's history. They are there to be remembered and respected because they form part of the intrinsic value of the Club. This value does not show up in the balance sheet, but take it away and the club is worthless. Mr Cortese, please sit down with the past players of our club and sort this out, for all our sakes.
Terry Paine - newly appointed Club President. Jason Dodd - Well respected for his work with the youth team. John Sydenham has always been welcomed at the club when he visits the UK.
Still visits regularly (usually as a guest of one or other of the exec box holders).
It seems Mr Cortese only has issues with ex players who see fit to bad mouth him and/or the club in the press, now why on earth could that be?

what has ambassadorial got t6o do with a house?
Benali & LeTissier owe there whole standing in life through the Saints.
Benali was cr+p LeTissier brilliant.
what teams came in with high offers for Benali?
How can anyone say he's Saints through & through when he's suing the Saints?
Does that mean if Nicola runs me over deliberately tomorrow and reverses over my head, I should get up and shake his hand? Or phone Lawyers for You? Or go to hospital?
If it's true it was Cortese so if he's suing the club for it he'll get thrown out on a technicality as he's suing the wrong one.
I laugh when I read these posts about Saints through & through from fans.
As I've said I was there the year we got relegated the next year with seats empty & the only fans being under the stands I was also there when we lost to Ipswich & if I remember correctly it was 7.0.
my friends & I went all over this country supporting Saints.
then we had a good cup run then we were going to Wembley suddenly we had fans coming out of the woodwork.
my friends couldn't get to the dell in time & couldn't get a ticket to the final & the next year same thing about season tickets so they stopped going.
Exactly when did you start supporting Saints?
I've seen some great players at Saints but Benali wasn't one of them.
he says Cortese wrecked his home exactly what proof has he got & why are you so ready to believe him instead of the saviour of your club?

There is nothing wrong with Matt talking to the media has revealed nothing that was not already in the public arena. Most has been revealed by the Echo. All this agression towards Matt and Franny is totally out of order and probably mostly from those who are too young to understand the history of the Club or can't see beneath the surface of a very singleminded Italian businessman.

Franny obviousy considers he has a very strong case and is risking his own money in legal costs, as did the Directors of Solent Interiors
No doubt Cortese, the shyster, was devious enough to let SFC lease the property in its name, so Franny has no option but to sue the club he loves and served so well.
Of course the costs of defending the shyster's abuse of Franny's property will be met by SFC Ltd., not a penny will come out of the shyster's pocket.
Who will pay in the end? why the Saints fans through the turnstiles.

The shyster was lining up Nigel for the sack regardless of the team's improvement.
Next thing the Cortese supporters will be telling us is that Chris Huhne is a great guy -- to my mind they are both beneath contempt.

Why do you say ex-Saints players?
There are several still working for the club.
Terry Paine spring to mind?
Troublemakers are not encouraged.
Programme sellers?
The replacements do exactly the same as before, just a lot more professionally.
If you are going claim something as a fact then be prepared to give your source and evidence.

If SFC is wrong then should pay, equally if FB has no leg to stand on he should also pay the price...no doubt costs!
From an outsiders view point the law is the law, and just because you are a big company, doesn't mean you can bully the small company or individual just because! FB must have a case or it would not have gone this far. SFC are trying to save face as far as I can see.
If rumours are true there will be an out of court settlement at the last minute so the club's name is not dragged through the mud again.
Just because FB is an ex-Saints player "the club" possibly thinks his loyalty will see him give in...but why should anyone give ground?
Anyway why all the articles on this - can we have more about the important matter of the games ahead?

The bigger the company the more money they can throw at a legal claim the more likely it is that the small boys will give up as they cannot afford the costs, so give up even if they are in the right. In many cases paying more in legal cost than if would to settle the case just to say don't you dare question us we can do what we want, just as SFC have been doing for the last few years.

Tell it as I see it wrote:Mr Cortese will be aware that in an entertainment business, there is no bad news. Only no news is bad news. He should also expect prominent ex-stars of SFC to have direct channels to the public psyche, through a hungry press. One way of handling the resulting media interest is to be aggressive, which is the chosen route of Mr Cortese. This seldom works as enemies only accumulate. That is where he finds himself at the moment. He will have to learn to win people over by persuasion, rather than picking up his ball, chosing those that pay lip service to his methods, and playing his game, his way, in his own backyard.
Bingo from Sholing wrote:I totally respect your sentiments however there are problems with your reasoning.

A lot of the comments here talk as though we are a League 1 team made good, rather than a club that had an unbroken 27-year stay in the top-flight. Money has been provided by Marcus Liebherr, his family and the sale of very talented players that have been developed by this club, mostly before he arrived.
Cortese sacked, Pardew who the fans adored and was doing a decent job, sacked Adkins, who the fans adored and gained 2 promotions and was turning things around. He has probably signed the cheques for the purchase of Lambert, Cork and some others that have contributed along the way. However, he was probably responsible for the drawn out sagas with Ramirez and possibly Coutinho and others that have so far not proved significant in the advancement of the Club.He has upset a lot of loyal supporters, explayers, exmanagers, media and others with his totally unempathetic and disrespectful approach. Yes, success makes money and can't be achieved without it, but it's not his and he hasn't contributed in real terms.

It is easy to see how shysters come to power with the happy clappies fauning over everything Cortese does as if he is blessed with the Pope's power of infallibilty.

How soon the happy clappies have forgotten their heroes like NA,AP,LeTiss --well they say there's none so fickle as a football fan ---. this column proves it.

The reason that Franny is suing Saints is because Cortese is employed bySaints the rental would have been made by the Club. Franny was actually a decent left back in his time. All his games were at the top level. Matt is right to support him and his ex-colleagues.Cortes
e is not a respectful man and is not the saviour of our Club. There is nothing wrong with Matt talking to the media has revealed nothing that was not already in the public arena. Most has been revealed by the Echo. All this agression towards Matt and Franny is totally out of order and probably mostly from those who are too young to understand the history of the Club or can't see beneath the surface of a very singleminded Italian businessman.
i joint the TA but I still kept an eye on Saints results.
I watched as the so called board of directors sold out the club to a company worth less than the club.
I remember how the fans were so grateful to Rupert Lowe for St.Mary's but then saw how that changed & it was right to change as the guy didn't have a clue on how to run a sports company which is what Saints is.
Did any fan put that debacle at the door of the real culprits?
did we see pickets outside the directors houses who sold it to Lowe?
NO we didn't.
Then please explain to me how close did we get to closing down?
From the reports in the papers & from some Saints fans CORTESE talked Liebher into buying this club so YES he is the SAVIOUR of this club.
I was asked to go & play a sport I loved as a school boy so I did & the fans & players are far more dedicated to their clubs than football fans are.
Last week you saw a great England team win against a full strength Scotland.
I say go ahead turn on Cortese let him turn his back on the Saints let the Liebher family go then see if SouthamptonFC survives.
let's see Franni come to the rescue after all he's Saints through & through isn't he?
I'll carry on watching a great sport whilst looking at Saints results & see how long we'll end up like Pompey

Cortese sacked AP, hasn't done us any harm at all, he employed someone better, he has now dismissed NA, and perhaps we once again will have got someone even better, who you don't appear to want to give a chance to, why? NC may have upset some fans, some have taken it hard, most have got over it, but none to the extremes of yourself and Tebourba, with the largest chips on your shoulders ever seen in the Clubs history, why? The prime objective is to make enough money to keep the Clubs future secure, pussyfooting around will see an instant decline, if everyone took your attitude we would be back in mire, big time. You criticise, but you never make a postive contribution to the argument, think about it, why?

Question for the borer.
There are people who post on here who know more than you do about some of the incidents you claim to have knowledge of.
..I do not agree with the 'apparent' handling of Nigel Adkins BUT i would never accuse him of not having anything but the clubs best interest's at heart..
You for some reason would not give him credit if he set fire to hisnuts and put them out with a cricket bat for the clubs cause..ergo you are not a Saint just a WUM.
Marcus supplied the money at Nicola's request both are equally deserving of respect..as a businessman with a multi billion European conglomerate Marcus could not hands on run it and bless him if he had with no Cortese were would we be now?..
..Marsus's demise without NC would have seen us slip back make no mistake...
... as a businessman I also understand the commercial facts of life we were brown bread no matter how illustrious our history...
...indeed history does not pay the bils ask pmuff ongoing success does ask Cortese!

Question for the borer.
