Swiss consortium talking with Fry about Southampton FC takeover

THE Daily Echo can reveal that representatives of the Swiss group interested in purchasing Saints have arrived in the UK for talks, this morning.

It is understood they are meeting administrator Mark Fry to discuss their potential takeover of the club.

Fry is attempting to get staff and players' wages paid as soon as possible.

That could be funded by the sale of another exclusivity period to a potential bidder.

Surely, we can't survive another 3 week exclusivity period as there'll be no players left to start the season with.

Really disappointed with Pinnacle and wonder whether Lynam is all mouth enjoying 15 mins in the spotlight?

also, doesn't wotte's contract run out the end of this week? who will sanction him staying on and getting paid? Just a thought. Probably the same issue with some of the players as well.

If Pinnacle are so confident that they will sign the contract and tie up the deal why don't they pay for another exclusivity period, covering the wages of staff?

I am with them in holding out with the league now. It is not right for them to blackmail the club to sign a waiver when we have every right to appeal the points deduction. If the league was so confident the points deduction will stand why can't they just accept that we will be appealing it and give us the licence to join the league!

They did the same thing with Bournemouth apparently...I think they're affraid if a club appeals they will win on a technicality and it will then cause other clubs to sue at the end of the season if we finish above them! The rules need changing anyway.

Seriously if Pinnacle are interested just do the deal. Forget the 10 points. Get a quality manager in, some quality players (money talks!!) and get us into the play-offs/promoted. Otherwise bugger off.

This needs to be sorted before the end of this month otherwise, players wise, we will be up the "creek" with no paddle.

What worries me most is that we are that close to losing Jason Euell........forever

Oh for fcuks sake, Saints have no right to appeal the points deduction. Points deduction is sanctioned by the league when the football operation can't pay its debts & enters insolvency procedings. Can only appeal in writing within 7 days of the orrigional decision, demonstraiting that the reason the club cant pay its debt are eithor:

Unforseen reduction in income (IE when ITV digital didn't pay or Setanta this year) - no other reasons. Please stop going on about the points, the waiver is standard FA practice and it was applied to 3 clubs last year. Not unfair, same rules for everybody!!! Some people on here are truly thick as sh1t init mush

I'm a bournemouth fan and unfortunately you guys have no hope. Leeds, us, Luton, Rotherham all punished twice for same crime with no hope of appeal. A week before the start of last season we were told accept the 17pts or not have a place in the league. Blackmail yes, did we have a choice no. They've set a precedent which they know is illegal but if they give in to you then how the hell do they sort all us out. Leeds and Rotherham would have been up. Luton and us never relegated. Just accept it, half your team did well for us in league 1 on loan. They know the league, you say 2 years. I think if you sort it out asap the 10pts will be gone by mid September and then play offs possibly. And remember i'm a Cherry!! Whatever happens dont have Jackson. He gave us all the c&£p as well, the managers we had lined up were fantastic!! Apparently

becoming a bit of ajoke now i can see a few fans defecting to reading and bournemouth. i know of few who have gone to eastliegh. some may even go to that lot down the m27 !!!! cmon pinnacle time to put up or shove off. we are only 3 or 4 days away from the loss of about 40% of our playing/coaching staff. the grim reaper is not far away in the form of a certain mr r*****t l**e ?????????

Move over and let someone who is serious about our club to finance our club.Not worry over a petty 10 points which would easily be eaten up buy a backer who puts there money up for some new players, and get some momentum going before we kick a ball. Cheap subsidised season tickets to get bums on seats, so the ground is full and the new team get the crowd behind them. Lynam put up or shove off we have had just about enough of you right to appeal, saints fans dont care about it, all we care about is playing in div3 and getting results on the pitch.

Absolutely spot on, I`ve been trying to get people to actually READ the League regulation 12 for weeks but I guess that takes brains, easier to mouth off about Lord M and whine it`s not fair.
The situation has been crystal clear from day one. The regs talk about an "insolvency event" , an example might be you can`t pay the staff! Saints agreed to the regs when they signed up at the beginning of last season. Fry knew there were 7 days to appeal although he probably realised Saints didn`t meet the appeal criteria. Don`t like it? There is a remedy- go to the high Court and ask for a judicial review!

Any buyer is going to have problems with the football league. What exactly is going on at the FL ? There is talk of another 15 points deduction. You cannot blame Pinnacle as anyone is not going to sign up to -25 points !

Got to be honest, im loosing faith in the Pinnacle Group. I dont really care about the -10 points. Id rather we took them, than be hated by every club in the land. I cant see what leverage the PG have over the FL. It will only drag on in the courts, and time is something we dont have. Sorry MLT, time to look around and think about the security of the club.Lets hope the swiss have a big cheese!

forget it . If the club isn't sold by the 17th of July then we get extra points deduction for starting season in admin, that means 16th July leaving only one day, if the legals take as long as pinnacles then this will all end in tears

We were disappointed at the Football League's decision last Monday to refuse a right of appeal in respect of the 10 point deduction.

We are also disappointed that the granting of a licence to play in League 1 is dependent on the club agreeing to waive the right to appeal against the said deduction.

Having taken legal advice we understand that, under the Unfair Contract Terms Act 1977, it may be possible to challenge this clause retrospectively.

We are further advised that an agreement signed under duress may breach Human Rights legislation.

I am sure you will agree that it would be preferable for both parties and for the good of the game at large that these issues be resolved outside of the legal arena.

Would you please let us have your response by Friday 26 June. We intend to sign an agreement to allow you to issue the licence at that time.

Why so many people turning their back on Pinnacle? They’re the only group that has come forward and done anything to help this club. The only other group that has said anything is Marc Jackson’s consortium with a poor offer.

This wait is getting to all of us but some of these comments on here is like children waiting to see Santa at Christmas! I have been reading these comments over the last week and most is pointless rumours that people are trying to make up so if it does come true they can say ‘I told you so’, anyone can make a relatively believable prediction and get some, most or if not all of it right, but please this is playground stuff.

We all support the Saints and therefore should support anyone who want to buy the club. A lot of people think that we are a bigger club than what we actually are, we should be grateful of any potential investment, because after all not every club can be a jammy as Pompey.

Come on someone buy the club so that we can finally start re-building for the future. Even a poor offer like Marc Jackon’s will be welcome now, at least there might be some room for decent investment after, but my ideal buyer would still be Pinnacle.

For a kick off Saints have not "not paid the Staff"

Its only know that the League are refusing to give a licence that the Pinnacle Deal has fallen at the 11th hour and Staff are not going to get paid.

Panicle are not the bad guys here. They are not making conditions on their purchase the League are.

What do you expect Pinnacle to do? They where only given the waver on Monday? No-one signs anything without reading it!

Pedant - I agree with the call for a judicial review. Not just for saints, their fans and their employees but for everyone involved in football.

The Football League have made some grave errors in the last couple of years and are backing them up with bulling tactics

Just in on SSN - we have to waive the right to appeal and admit SFC in administration to play football in L1 next season. Admitting in administration means another 15 point penalty...this stinks! Don't sign and see the sh1t hoit the fan when we go out of business! No fixtures for teams in L1 - still who wants to go to Southampton anyway?

Just seen Sky sports interview of TL. Basically he is saying that any lawyer in the land would find the FL document/waiver illegal as Saints are not and have not been in Adminstration! He says FL does not have all the facts and they are currently in discussion with them.
He also said when Mcwhinny announced the decision he said that we could appeal but we wouldn't win and was not therefore worried if we did appeal! There has been a change of mind.
Clearly PG seem very sure of their facts which must be backed by legal brains but I gauge it will take sometime before its resolved. Also, surely any other bidder will go down this route following legal advice so it will take time to sort regardless who is the preferred bidder!
More waiting but I still feel PG are doing the best possible job for themselves and the club.

in short probably yes. you have to see it from another bidder's perspective, before they commit to a deal with Fry they will need to see the books and formulate their business plan for the league (propose a board etc)
its Lynam and pinnacle you will have to thank if a further points deduction is levied. they knew they werent going to go ahead unless they could overturn the -10 points penalty. but rather that be open & honest about it they paraded around the papers, tv, radio and websites making promises they knew!!! they weren't going to keep.

Absolutely spot on, I`ve been trying to get people to actually READ the League regulation 12 for weeks but I guess that takes brains, easier to mouth off about Lord M and whine it`s not fair.
The situation has been crystal clear from day one. The regs talk about an "insolvency event" , an example might be you can`t pay the staff! Saints agreed to the regs when they signed up at the beginning of last season. Fry knew there were 7 days to appeal although he probably realised Saints didn`t meet the appeal criteria. Don`t like it? There is a remedy- go to the high Court and ask for a judicial review!
When Fry, Pinnacle etc use the word 'appeal' they are referring to a visit to a law court which is why the league is so frightened. The league regulations on appeals are irrelevant. The league would not mind giving us an internal appeal today and they'd hand it to the Norwich chairman for the inevitable 'no'.

Where Pinnacle have failed badly is in not getting on to this issue on day 1, hour 1 of the exclusivity period. Surely if they were serious about taking over but with a serious reservation over the 10 point deduction they would have looked into it straightaway. Luton/Rotherham etc are cases on the record from not very long ago. It is no good saying 'the league only told us on Wednesday' - FFS if I was investing several millions I would have been FINDING OUT about these things from the start - not waiting to be told and then reacting...

They cant appeal to the court, as this is not a dispute over the laws of the land, just the regulations of a private members club which we signed up to and agreed to abide by. Pedant may be correct in suggesting a juditial review, however again generally this would only look at a decision made under a point of law which is not appealable to a relevent tribunal or court. If Pinnacle don't know the difference we are lucky they don't look likely to complete the deal, if they do then it's just further evidence they have been stringing us along

I don't understand this 'private members club' argument. If a golf club puts a clause in its rules and regs that either breaks the law or is against natural justice then anyone (not just a member) can take them to court. If the league has acted unfairly and it costs Saints money then of course they can seek legal redress. Just as you could take your golf club to court under discrimination, equality, health and safety laws etc + if they treated you unfairly in a way that caused you injury, loss of money etc. Alright so people don't tend to take legal action against their golf club but it doesn't mean they can't.

Why, if what you are arguing is so clearcut, are the league so obviously AFRAID of this going to the courts?

Matthew Le Tissier believes that the takeover of Southampton by the Pinnacle Group will go through despite its reluctance to accept a ten-point deduction imposed by the Football League.

San Marco, no they can't. Golf clubs, like anything else, can be taken to court if their rules break the law. There are specific laws banning certain forms of discrimination, like on grounds of sex, disability, sexual preference a religious belief. If the league broke these rules they could be sued, if they don't...

Leon Crouch admitted on local radio that the only reason a holding company was set up was to try and avoid a 10 point penalty should you go into administration.

Stop whinging on and on about how unfair and unjust the FL are ...when they did they same thing to Luton, Leeds, etc etc ..and you are no different.

Companies House records clearly show that Southampton Football Club Limited (formed 1897)are a member with no mention of SLH.

Absolutely spot on, I`ve been trying to get people to actually READ the League regulation 12 for weeks but I guess that takes brains, easier to mouth off about Lord M and whine it`s not fair. The situation has been crystal clear from day one. The regs talk about an "insolvency event" , an example might be you can`t pay the staff! Saints agreed to the regs when they signed up at the beginning of last season. Fry knew there were 7 days to appeal although he probably realised Saints didn`t meet the appeal criteria. Don`t like it? There is a remedy- go to the high Court and ask for a judicial review!
When Fry, Pinnacle etc use the word 'appeal' they are referring to a visit to a law court which is why the league is so frightened. The league regulations on appeals are irrelevant. The league would not mind giving us an internal appeal today and they'd hand it to the Norwich chairman for the inevitable 'no'. Where Pinnacle have failed badly is in not getting on to this issue on day 1, hour 1 of the exclusivity period. Surely if they were serious about taking over but with a serious reservation over the 10 point deduction they would have looked into it straightaway. Luton/Rotherham etc are cases on the record from not very long ago. It is no good saying 'the league only told us on Wednesday' - FFS if I was investing several millions I would have been FINDING OUT about these things from the start - not waiting to be told and then reacting...
The League appeals procedure is , I agree, now irrelevant because of the criteria in Regulation 12. If you read all of the regulation you will see that it is not simply a question of giving an internal appeal to the Norwich chairman. An appeals panel is formed by arbitrators independent of the FL. Slagging off the FL without looking at the regs is sinking to the ECHO level. I agree with you San Marco, one would have thought that serious bidders (with lawyers) would have aquainted themselves with the regs at the beginning of all this.

SLH (our holding company) were formed in 1997 . We still had another 8 seasons of Premiership football ahead !!! Hard to believe then that it was set up to avoid a 10 point that may or may not occur in the future.

Hey, I have about £20k worth of credit on my credit cards. I could go out and buy a pretty nice new car but doesnt mean I can afford it! You are losing more money per year than the total debt of SFC. And with very poor income other than player sales and Sky money (which wont improve in the short term) you have very worrying times ahead of you. You better pray for your take over.

I am a Pompey fan but rather than indulge in pointless bickering I'll ask you a few questions:
1. Do you honestly think you could appeal that SLH is distinct from SFC when SFC was only able to pay last months wages owing to exclusivity funds from SLH?
2. Do you think a High Court Judge is going to agree that SFC is a solvent going concern when it has again failed to pay its staffs wages?
The rule was created to stop solvent clubs being taken down by insolvent parent companies. Is SFC solvent? No. The bloke banging on about Delia Smith yesterday was hilarious - Delia Smith is a chef who publishes cookbooks. Does SLH publish a cookbook? No. Does SLH have any other business tthan SFC? No. Do the league have the right to interpret this rule according to the spirit? Yes. Would the High Court accept the right of an insolvent football club to escape a deduction because of 'natural justice'? No, because natural justice is on the side of the league - you ARE bankrupt. Secondly, you have to go the court wth clean hands to claim natural justice, you are trying to use a legal manouevre to avoid getting a penalty that APPLIES to you.

There not trying to appeal, The were trying to get the right to appeal just like any other club would have done in this situation. So before you come on here pretending to have a interst get the facts right. Wait till your take over happens thats right it wont!!!!!!!!! Selling all your players in dept small ground cant make the money to cover your dud superstars eg sol campbell on over 100 grand a week. We shall see!!!!!

They had the right to appeal, and it expired 7 days after the event. They now want the right to have another appeal. I note you didn't dispute the facts you are bang to rights. Our takeover is just about complete, Sol is out of contract (get your facts right) and it was great value to see him lifting the FA cup. btw, just to correct your colleagues, our debt is smaller than yours, hence the takeover by minted Arabs.
