SOUTHAMPTON Football Club has been ordered to pay up nearly £60,000 after a row with a contractor ended in court.
The club has just two weeks to pay Solent Interior Systems Ltd for a major refurbishment of the luxury Mike Channon Suite at St Mary’s Stadium.
London’s Technology and Construction Court heard how the contractor started work in May and received the first three instalments of the fee as set out in a contract worth £315,000. But the court was told how the final £55,000 of the bill, due in July, was never paid.
An adjudication in August ruled that the club should hand over the money “immediately” along with interest built up in the month at £12.81 per day.
But despite further demands, no money was handed to the commercial outfitter, which is based in Lee-on-the-Solent, and no explanation was offered, the court heard.
The Mike Channon Suite, a conference and match day entertainment facility at St Mary’s, can host hundreds of guests.
A brochure on the club website describes it as a “stylish and spacious” venue which “exudes pure luxury” with a “plush interior” and “lavish carpeting”.
The club did not send a representative or a legal team to the case, emailing court officials a day before to signal their intention not to attend. In their absence, the club was ordered to pay £55,000 plus VAT as well as interest totalling £1,370.63 and legal costs of £3,309.
Mr Justice Robert Akenhead said he could “not understand” why the club had left it until the day before the hearing to tell the court they were not appearing for a defence against the claim.
“There does not appear to be a good reason why they did not do it three weeks ago to avoid paying these (legal) costs,” he said.
“I very much hope they honour this judgment as soon as possible.”
Outside the court, Amy Amison from PJ English Associates, the legal team representing Solent Interior Systems Ltd, said work on the refurbishment had overrun as a result of the club making variations to the project as it was going along.
She told the Daily Echo: “This has interrupted the cash flow of Solent Interior Systems quite significantly because they were expecting payment in July and it will be December before they receive the money.”
Southampton Football Club did not reply to requests for a comment last night.

To be fair a friend who attends matches in the same suite as me owns an interior company. He quoted for the work the summer before but at each meeting NC changed his mind on what he wanted. The club was also overly keen about damages for any overruns. He pulled out because he saw where it was going.

At a time when many businesses are facing difficult financial times, this does nothing to improve the club's reputation and may well make both businesses and other football clubs less willing to have dealings with the club.

Since Herr Liebherr died there has been nobody in a position to keep Cortese in check. We are not covering ourselves in glory on or off the pitch this season we are already strating to get a bad reputation with suppliers with many grumbling that we don't pay up. What's annoying is that whenever a story like this comes out, you get people up in arms spouting conspiracy theories about how badly the club is run, and how NC is running the club into the ground, and we're not paying that and didn't pay this. As someone posted above, its chicken feed in comparison to how much money is spent in football. What's annoying is that whenever a story like this comes out, you get people up in arms spouting conspiracy theories about how badly the club is run, and how NC is running the club into the ground, and we're not paying that and didn't pay this. It's all bullsh#t!
Similar cases like this happen on a regular basis where some bigger organization over looks to pay a bill. From looking into this it would seem this was a dispute because the work was not finished in time and so the club were witholding the payment as a consequence. However it seems the work was only delayed as the club asked for alterations. Possibly a genuine case of miscommunication or just crossed wires.
The club possibly realised it was a mistake, hence they never bothered to send representation as they were prepared to concede they were at fault.
I don't think there is anything sinister within this at all, it is common this kind of thing happens in larger organizations, especially when various people maybe responsible for taking such contracts and then relaying information for the accounts / finance department to settle payments.
However, I would be very careful in upsetting our Don, he has a good supply of horses!!

People often complain when chairman crave the attention and then moan when they work in the background and keep out of the limelight... You can't have it both ways.
I prefer it this way, I think Nicola has done a sound job so far.
As for the people who have "inside knowledge" or know "somebody who worked at Saints and they were not happy"... Well I know people that used to work for my company and they have nothing but bad things to say. Possibly because they were lazy oiks who didn't want to work hard for a living and so when they were relieved of their duties it was because the company was at fault... Funny how views can be distorted isn't it?

In seven or eight weeks the transfer window will open and with the team's position in the league, it is reasonable to assume that the club will want to buy to reinforce the squad.

As someone posted above, its chicken feed in comparison to how much money is spent in football. What's annoying is that whenever a story like this comes out, you get people up in arms spouting conspiracy theories about how badly the club is run, and how NC is running the club into the ground, and we're not paying that and didn't pay this. It's all bullsh#t!
Similar cases like this happen on a regular basis where some bigger organization over looks to pay a bill. From looking into this it would seem this was a dispute because the work was not finished in time and so the club were witholding the payment as a consequence. However it seems the work was only delayed as the club asked for alterations. Possibly a genuine case of miscommunication or just crossed wires.
The club possibly realised it was a mistake, hence they never bothered to send representation as they were prepared to concede they were at fault.
I don't think there is anything sinister within this at all, it is common this kind of thing happens in larger organizations, especially when various people maybe responsible for taking such contracts and then relaying information for the accounts / finance department to settle payments.
However, I would be very careful in upsetting our Don, he has a good supply of horses!!
Reminders would have been sent.
The club would have been made aware that they were required to attend court, and could have settled the bill there and then, which would have avoided the unwelcome publicity.
Why is that supporters can feel justified to criticise a player when he has a bad game, but when the club' s administrators screw up, they try to defend them?
No ifs. No buts.
The club got it wrong.
A LOCAL firm had to take them to court to get money owed.

The one fact is that SFC held back on a final payment of £55k - a normal event in anyone's life if you wish for clarity before making a final settlement. It seems that they had a continuing disagreement that required a Court to settle - again, not an unusual event in a dispute. Result? SFC pay the £55K + VAT as per original Invoice, Plus another £4,679.63 in Interest and Legal costs. Let me repeat that - we are only talking about £4,679.63 extra on top of a Bill of £315,000! About 1.5%!

All the doom merchants and skates will say this points to certain doom and financial ruin.. It doesn't. What it means is that somebody in administration at Southampton messed up and it isn't good. But that is all it is, it happens, there is nothing sinister.
My point was about the people who will make a bigger deal about this story than there really is. There are certain people who would love to think Southampton are going into financial meltdown because of unpaid bill. In the same way people over reacted when the building work of the new training facilities were suspended.
This is just what it is, a bill that was unpaid and a big mistake in Southampton admin and a bad bit of PR.

I'm sorry, but football clubs are huge multi million pound companies (especially in the top flight). Whilst £60k to us is a lot of money, I doubt it registers as such in the world of football do you? This was a £60k last settlement, not £600,000!
I am sure a company with the turnover of Southampton would not need to go through the executive chairman for all such payments... Now if it had been £600,000 I am sure that is a different story.

Look, I'm not worried what footballers, managers or chairman earn. If they are good at their job they should get paid well for it, I have no problem with that.
Nicola Cortese was well respected by Markus Liebherr, and if he was happy to pay him 600,000 per year or 6 million per year that is his prerogative. Markus trusted him to do the job, for me he has done exactly what he promised us. As far as I am concerned delivering on a promise speaks volumes and tells me far more than what some of the NC knockers would have us believe.

The point that I, and others, are attempting to make is that it should never have reached this stage.
Southampton Football Club have some standing, not just in the local community, but country-wide, and this sort of story, in these financially troubled times, is something that I would think, and competent businessman would want to avoid.
It is not just Saints' fans that are aware of this reluctance to pay money owed, but also other local businesses who the club may wish to employ at some time.
If you were a local businessman and were approached by the club to do a few thousands pounds worth of work, would you be happy to do so, or would you be wondering whether, if you did the job, you would have to hire a lawyer to get your money?
Try to divorce yourself from club loyalty before you answer.

I have no doubt that the first request for payment did not arrive on Cortese's desk, and I can accept that he may not have seen the second request, but I would bet that someone showed him the letter from the firm's solicitor asking the club to pay up or go to court.
No good trying to claim that anyone who thinks differently to you is a Pompey supporter. Not every Saints fan is blinkered in their support, and are honest enough to know that, when a job has been done, the people who did the work are entitled to be paid.

only a complete idiot would read anything "postive" into this story. It brings shame on the club with regards its local reputation, will harm the club's ability to attract good contractors and shows that a total clown ( whoever that is ) is in charge of legal matters. This is not down to personalities, its down to the club looking amateur and shabby.
The club contributes to the local economy; the local economy provides the support that ultimately keeps the club alive.
This is an own goal from saints that deserves to be reported, to keep the financial back office honest if nothing else.
Anyone suggesting that this points to financial difficulties is lacking perspective, though. Currently saints pay many, many multiples of this figure in weekly salaries alone.
What this points to is a sloppy financial team and poor advice from Nicola's pr team.
Nicola should be reading the riot act to his lawyers and the paymaster over this one. On some level, I think he is. But who knows? The sound of crickets chirruping is deafening from the saints or department.

He didnt care if they survived or didnt - he just wasnt going to pay! The contract was completed in its entirety, The are no serious allegations of defective work - bar minor snagging professionally valued at £750 - and there are two other on going court actions between these two parties involving further substantial amounts. Thankfully, Solent Interiors are a strong and well run company and were able to survive this. Many companies would have folded being owed more than £100k from someone who refuses to pay.

If you were a local businessman and were approached by the club to do a few thousands pounds worth of work, would you be happy to do so, or would you be wondering whether, if you did the job, you would have to hire a lawyer to get your money?
Try to divorce yourself from club loyalty before you answer.

I think the Directors of Solent Interiors and their honest hardworking employees give more than a fig for this court case, their livelihood and the welfare of their families depends on it !
No doubt Cortese on his £600k a year wouldn't understand this.
